Is their decision right?

Have been and still am, a customer of Classic Confidence UK. Thought I would see if I was eligible for PPI Refund.

To keep details short:

Had account since 11th April 1994. It included a PPI which I assumed was mandatory or be refused application. It was leaflet Form and no one gave me any info re this.

Cancelled PPI 13th September 2007 as was finding repayments difficult with added PPI. Thought they would stop my account but heard nothing.

Yesterday I sent an email to Classic stating my details and that I believed I was eligible for a refund.

ANSWER RECEIVED FROM THEIR COMPLIANCE DEPT:

The policy was optional and could cancel at any time, or queried the charges.
They gave me sufficient information and that I have had 5yrs since cancellation when I ought reasonably to lodge a complaint.
They believe the time limits have already expired being around 19yrs after sale and that I should have been aware of its existence.
They said if I was nit happy, to contact the FOS.
This was, they said, was their final response to this matter.

AM I FLOGGING A DEAD HORSE?

THIS IS THE FIRST TIME I HAVE APPLIED FOR PPI REFUND

CAN ANYONE ADVISE PLEASE?

    You are not eligible for a refund. You make a complaint.

    If it was leaflet form, you bought it, it wasn't sold to you. You can contact the FOS if you want to, since they've told you you can, but they weren't regulated at the time so I've no idea how that one would work unless they agreed to be bound by the FOSs decision.

    If you think your complaint is strong enough, do it.

    Is this a card or a loan?.
    As the account is still running, send this to FOS, say that you have recently become aware of PPI that may have been mis sold, put that you cancelled this in 07 as you could not afford this.
    Did you keep the repayments up to date? if you did and you had a good sick package from work, life or other insurance, maybe savings so that you could repay this Loan/Card in any event or a pre existing illness that meant you could not claim on this insurance or were a student working less than 16 hours a week, use these as reasons for mis sell.
    You have nothing to lose at this point.

    There is no such thing as being eligible for a refund. You make a complaint giving your reasons for complaint and they decide on the validity of your complaint.

    if you disagree with their response then you refer the complaint to the FOS. Your complaint reason is very weak if that is your only reason. (i.e. you made an assumption and no-one actually sold it to you). Do, you have a stronger reason such as those amersall mentions?
