Nursery took double fees!

This is quite a money-oriented question but wasn't sure what section to put it in, so hoping somebody here can advise.
Basically as the title says nursery took double lot of fees out of my bank account this month. I alerted the nursery manager to it straight away and she looked into it and apologised - their error.
But they still haven't returned the overpayment and its a week and half later. I just keep getting excuses, "its on it's way", "will be 3 working days" (its now been 7) "looking into why its not been processed" etc.
If I don't pay my fees they can chuck my child out, but when its the other way round is there anything I can do! I was wondering if I should ask them to cover the interest on the overdraft?

They should cover the costs or any consequential loss like OD charges and interest costs.
WRITE to them giving them one week to repay the fees (headed leterr before action) and advise them of the additional costs that you have incurred.If you've have not made a mistake, you've made nothing0 -

Whilst I sympathise with your situation, I expect the interest would only be pence.
Do you pay weekly? If so don't pay next week. If monthly, go in and ask for a cheque or cash on the spot, tell them you need it and it is their error.

No you don't. This comes under the Direct Debit Guarantee. You just need to notify your bank that the second payment was taken without authorisation. The bank will refund you and seek reimbursement from the payee.I'm a retired employment solicitor. Yay - the refund is finally showing up in my account today.
