Grr! What is wrong with Halifax?!

Right, finished 7 night shifts, baby in bed, hubby at work so I can explain further.....
From what I can gather, the CC have used my card details from a previous payment plan set up last year in October. I defaulted in November and December (maternity pay really isn't all it's cracked up to be!!) and they wrote to me saying the payment plan was off. In January they didn't take any money from my account and I entered into the DRO. THEN they started taking money from my account. February and March were both refunded by Halifax once I had explained about the DRO (they knew about it as had been informed by OR) and I had told Halifax that they shouldn't be taking money (does this constitute telling them to cancel payments? Don't think so as I didn't say the magic words!!)
FOS have taken this up now as I am completely dissatisfied with the final response (we still believe this to be a valid transaction) and the young lady I spoke to gave the impression that Halifax are out of order but we'll see I guess.
So what do I do regarding my BA? Is it wise to close it before the FOS finish their investigation? I have started paying all monies into my partners account and have stopped all activity with a view of closing it ASAP but don't know when is best.0 -
So you can default on a default plan but you complain when they take a payment which looks as it is owing - I would suggest the FOS will wipe their hands of this.0

Whether I defaulted on a default plan is completely irrelevent, I have a DRO in place and they have been informed by the OR that they are not to take money so NO it is not owing. I defaulted as I was in financial crap you d!psh!t, hence the DRO.
Stupid comments like that are really unhelpful and not very well thought out, perhaps you should spend your time crying about the impending departure of Rooney (also not a very helpful comment but it made me feel better)
Also, they cancelled the plan so why did they suddenly start taking money again without speaking to me??!!0 -
Unless you are declared bankrupt no creditor HAS to accept your debt plan.0

Do you understand what DRO is jones? I suspect not given your replies. It is an order granted by the insolvency service but is cheaper than going bankrupt as there are certain criteria you have to meet (like debts not totaling more than £15000 etc). It is a form of bankruptcy, I will be discharged from the DRO in January and my debts will be wiped, as they would be when discharged from bankruptcy.0

That's not correct.

"5. Debt Relief Orders
Debt Relief Orders (DROs) are one way to deal with your debts if you owe less than £15,000, have little spare income and don’t own your home.
If you get one:
your creditors can’t recover their money without the court’s permission
you’re usually freed (‘discharged’) from your debts after 12 months"
If Vanquis knew about the DRO, they should not have taken money from the OP and Halifax should refund this money immediately. What will your verse be?

There is no excuse for this sort of posting. It is totally unnecessary.
Earlier in this thread you complained that your previous posts weren't be replied to.
One of those threads told you to post on the Debt-free Wannabe forum. It was clear advice that you should have taken. There you will find a higher level of expertise about debts, DROs and more. You'll also get a lot more empathy and support.
Throwing out insults because somebody doesn't understand what a DRO is helps nobody.
You're posting in the wrong place. I could call you something offensive for having failed to take good advice when it was given a few weeks ago. But it won't help you.
Start again. But post in the right place. Or carry on with the insults and watch other posters turn away from you.0
