Query with buying a flat in Scotland

Hi, my friend and I bid for a flat in Edinburgh a couple of weeks ago. We put in our offer of £90,000 but the seller didn't accept it.

We talked to our solicitor and said we would increase our offer by £2,000. We received a phone call later that day to say the seller had accepted our new offer.

Two weeks later, we still only have the paperwork from the original offer of £90,000. We called our solicitor's office and his secretary said she had no further paperwork in her files. We are having doubts!

If we don't get updated paperwork from our solicitor for the new bid of £92,000 how do we stand legally? I think the seller's solicitors are keen to conclude missives in a few days time. Help!

Thanks.

If the seller's solicitors conclude missives without 'qualifying' your offer (i.e. amending the figure), then you'll get the flat for £90,000 - but they won't. At some point this amendment will find its way into the missives, and the deal will be concluded at £92,000.
