Parking Charge Notice number 2

First of all, please can I thank all those that gave me advice after I received a PCN last year. After ignoring 8 separate demands over 7 months, I have not heard anything since.

Just when I thought it was safe to park my car, I have received another one from G24. This one is again via a camera where the driver is alleged to have stayed beyond the 90 minute free parking limit in a superstore car park by 51 minutes.

The signage was not clear as you entered the car park which was practically empty at this time.

I am planning to ignore this notice as I did with the previous one but wanted to know whether I have any additional obligations since the 1st October 2012 ?

The wording on the notice is;

Under the Protection of Freedoms Act 2012, Schedule 4, you are now required to do one of the following by no later than the last day of the period of 28 days (beginning with the day after the date on which this notice to registered keeper is issued):

a) Pay the outstanding amount of the Parking Charge, if you were the driver, OR:
b) If you were not the driver, provide us with the full name and current address of the driver of the vehicle (you are also required to pass this notice to the driver),OR:
c) Make a representation against the issue of the Parking Charge.

If, at the end of the period of 28 days (beginning with the day after the date on which this notice to registered keeper is issued), you have not complied with the above, then you (as the vehicle's registered keeper) will become liable to pay the unpaid parking charge and we will have the right to take recovery action against you.


Is this correct or are G24 similar to the other scammers ?

    Basically correct.

    This time, though, I would not ignore. I would go for a POPLA appeal. Any recent thread here will give you the picture.

    A couple of points.

    Date of contravention
    Date of receipt and date on the actual Notice to Keeper letter in post#1. Just to check they are in time.

    The date of contravention was 16th June. The notice was dated 25th June HOWEVER, I have been away on holiday for 2 weeks and didn't open the letter until 9th July which was also the deadline for paying the reduced amount so I missed that as well !

    I'm about to write my appeal to G24 based on the following grounds:

    1. Punitive (£100 charge when nearby public carparks charge around a £1 per hour). My vehicle is alleged to have overstayed its welcome by 51 minutes.

    2. Signs not clearly displayed. There are no G24 signs as you enter the carpark and if you park on the left there are no signs either. There is a sign on a gate at the entrance but this permanently open meaning the sign is back to front. Therefore you can easily park your vehicle without seeing a G24 sign. I have video and photographic evidence of this.

    I would welcome views on this. Are there any good template letters relating to the above and should I submit the photo evidence with my G24 appeal or wait for the POPLA appeal ?

    What you propose is absolutely fine. The really important thing is to say nothing which gives away the driver's identity. Write in the third person as the keeper e.g. "The keeper denies liability blah blah blah...".

    By all means submit your photo evidence. For most PPC's I would say don't bother because they will reject anyway, but G24 has been known to fold at the first challenge, so go for it.

    Sounds good to me, you could add a quote from Appendix B of the BPA Code of Practice (yours is covered by the March 2013 version not the new one). Shows G24 you've looked it up and mean business! I think Appendix B is the part summarising mandatory requirements for entrance signs.

    We also encourage complaints to the retail Store Manager (or Managing Agent if several Stores onsite). They can often cancel a fake PCN for a customer who 'shouts' loudly.

    Given G24 have been caught out on their discount rates could I ask what they are asking you to pay if you do it in the first 14 days - it should be no more that £60 according to the BPA 40% discount rule.

    It was initially £60 but I was away on holiday for 2 weeks and the date had passed when I opened the envelope.
