hello all. new to the forum. two years ago i paid to do my hgv course, threw a well know online company. i payed £1896 pound after saving up to take the time off work, i decided to ask for a refund. i feel really let down and i don't know what to do. it seemed a good idea at the time and the company kept ringing me to pay the full amount so i did. but then they stopped phoning and feel they could have done more to get me round to doing it. after thinking about it all they are a sale reps. anyways i phoned and asked for a refund and i was told there would be a cancellation charge i thought fair enough it mite be a re pound. but its 80% so in total i paid £1896.00 and they are wanting to pay me back £179.00 with other charges :-( please can someone help me???? many thanks in advance. how wrong is it they can do this? all iv had is two books and im sure iv never had to accept any of there terms and conditions? helppppppp

Ask them if you can transfer it to another person and see if you can sell it.
What training center & company is it?
I do feel their offer is unreasonable, but then they've done nothing wrong and you have no statutory right to cancel, started providing the service but you've simply not actively pursued it. Not really their fault. I would have though expected a deduction of around £300-£400.
I suspect their defence is that you have entered in to the contract and are still honoring that contract.0 -
So you paid nearly £2k 2 years ago. But never got round to taking the course......
Just how long after paying did you ask for a refund?Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
its threw a company called easy as hgv. i enquirerd about the course threw there website and was phoned back by the company and the company was all nice and wanted the sale. and all iv had of them is two books for the theory test and that's it. you would of thought they would be reasonable about a refund i wouldn't mind loosing a couple of hundred but i feel they are really taking the mick. so i don't have any rights to any more of the money. i wasn't told of any term and conditions when they were wanting my money. any more advise would be greatly apprenticed0

You don't have many options, you can go to court to have a judge decide, I suspect you would get a lot more back despite you breaching the contract.
You could try negotiate with them.
Or see if you can transfer the course.
How much would you accept back from this? What exactly does it include? Sounds expensive to me, unless it includes module 4 of CPC in which case about right0 -
Not sure if this is legal or not but it does state on their online terms and conditions that after 6months they will only refund 20%
4.3.1 Cancelling a course: If you cancel a course: (a) within 7 days of booking you receive a full refund, minus the cost of any course elements you have already begun or completed (b) after 7 days but no longer than one month after booking we will refund you 60% of your payment (c) after 1 month but no longer than 6 months we will refund you 40% of what you have paid (d) after six months after booking 20% of what you paid will be refunded to you0 -
It included the theory test , the practical test and pass protection. And cpc course. Maybe ill just have to go do it. Due to family and work commitments I just haven't been able to do it. But ill have to find a way to. Many thanks everyone I thought I would have had more rights0

As arcon5 has said, you could probably get more back. But it's going to be a lot of hassle - probably easier to just do the course.0
