Starting to reclaim hsbc bank charges

Hi i have just started to try and reclaim my bank charges back from HSBC, i have used the initial letter on here requesting all transactions for data under the data protection act, also including a previous address for the last 6 years, this was on the 20th june, today i have recieved a letter of overdraft charges relating to the last 12 years, but not all charges are on there so my question is Do i use these charges to calculate what i can claim for or do i request the rest of the transactions and charges? any advice would be appreciated as i am stuck at the mo, thanks in advance.

You do know that the bank won the court case so that only if you are in financial hardship onw would you even be considered (and you will need to provide an incoming/outgoing expenditure to show this, no mobile phone contracts, no sky etc).
Even then most bank will only consider the last 6 months.0 -
Yes i understand that, i have read a lot about it before i considered trying to reclaim my bank charges, but there is no reason why i cant try, and the situation my family and I are in at the moment would count as financial hardship i am not at the stage yet of asking for my money back just requesting all my information, and going about it properly, thankyou.0

In which case, you inform the bank of your arrears on your priority debts and provide them with a breakdown of your income and outgoings and request that they consider a refund of your charges under financial hardship criteria. Make no mention of unfair or disproportionate as that will be an auto rejection.
If you are in financial hardship, hopefully your statement wont show any luxury items (pay tv, mobile phones, dining out etc). If so, they will consider it.but not all charges are on there so my question is Do i use these charges to calculate what i can claim for or do i request the rest of the transactions and charges?
You dont calculate anything. The bank will decide what action it wants to take going forward. If you qualify under their criteria some will look at the period you are in hardship. Others will look at the last 6 months only and/or look to suspend future charges and interest to allow you to get back under control.I am an Independent Financial Adviser (IFA). Why have you spent 10 of your precious pounds, indeed very precious pounds if you are in the financial hardship you are going to claim to be in, requesting details of bank charges if you already are aware of them??? :huh:0 -
HSBC tends to waive the £10 (and usually returns the cheque if one was enclosed) unless it's a full DPA request (which costs a hell of a lot more than £10 to process I assure you!). I doubt the OP will have had to pay anything.
To get a list of all your charges over the last x years is extremely simple at HSBC (thinking of the process now I count 4 clicks of the mouse and 2 fields to input on the keyboard), it's a 2 minute job and that includes waiting for the coffee machine to start up.
As another poster has said, don't include the words unfair/disproportionate/illegal etc as you will probably just be referred back to the High Court case.
Don't try and obtain a refund over the phone - The financial hardship teams very rarely refund charges (this doesn't mean they wont help). I'd suggest going to a branch and talking to a Manager/asking the person you've spoken to to refer it to a Manager. Branch Managers have a fair bit of leeway when it comes to fees (but they've got to be able to justify it just as much as anyone else, so come with a strong case).

ive looked at hardship cases before, its shocking that people claim they are in hardship and they still pay £75 each month to Sky, £50 mobile phone bills as you are referring to. I've even see people pay £200 a month to betting websites. it just baffles me.
