Bed Purchased from ebay via paypal ( guest account )

Afternoon all,

Couple of week ago i purchased a bed from a seller on ebay, they have over 10k positive feedback so was happy they were a good seller.... how wrong could i be...

Firstly it took 3 tries to get the bed delivered, then when it finally arrived it was different to the one advertised and also the trimming was very poor with wood showing through in places.

I emailed them, tried calling loads of times but got no response. I asked for a refund due to the fact its not as advertised and also of poor quality as was told that i would have to return the bed to them before they would do this. Surely as they have sent the wrong bed its down to them.

Please can someone advise where i stand on a full refund or replacement / compensation for time wasted on the matter.

Even got to the point where they were screening my calls as rang 3 times from my mobile with no reply then rang from my partner phone and they answered first time!!

help please

    You would be better posting this query on the ebay forum, but, for a guess, you could raise a claim through e bay for SNAD (significantly not as described)

    The law normally would say they should initiate the refund process as soon as you cancel the contract however 30 days is considered the upper limit for such a process to take.

    In the real world though, the vast majority of companies including your high street companies break this requirement as they clearly dont want to leave you with both the money and the goods.

    Why are you objecting to returning the goods? Even if you do lodge a complaint with eBay or PayPal they will require proof the goods were returned before they refund the monies.

    They want £40 to pick up the goods and its to far for me to take it back, as its there fault i don't see why i should pay £40 to return it.

    If there's a fault with the item, or the incorrect item was delivered, you have a right under SOGA to have all costs refunded, inuding delivery.

    The other company are also responsible for return costs, so they can arrange a suitable time for a courier to collect goods, it's not your responsibility to return them, you simply have to make them available for collection.

    Well don't bother then and you will time out on EBay/PayPal after 45 days and you can just resort to small claims court. But your refusal to send it back might count against you.

    yeah it was a buy now item.

    i'm not refusing to send it back, just don't see why i should have to pay £40 for them to come pick it up

    Back in the real world, you do unless you want to go to the small claims court. Ebay are a different entity when it comes to rights, ebay will side with you but only once they have proof you sent it back.

    Yes, I understand that is how ebay would like things to happen and maybe my reply was a little too brief. ;)

    I believe the OP should explain to whoever sold the bed to him that the bed does not conform to contract and is available to be collected by the seller at the seller's cost.

    The Op is not forced to follow ebay's processes.
    Ebay will readily tell you that they are not the seller.
