    Whether the customer had an opportunity to view the goods, or even a sample, is not important... unless the sale is actually made at a distance.

    I could see it potentially being a distance sale if the instore and online businesses were run seperately - eg a Tesco direct order placed within a Tesco store.

    Not saying that's the case here, it's just a scenario that comes to mind.

    althou Tesco direct was available in Stores before it was available online ;)

    How did you pay, OP?
    In cash?
    By chip-and-pin card?
    By typing your card details into the computer in store?

    What's wrong with the sink? Why do you want to return it? If you had seen it in store, would you have bought it or would you have known there and then that it wasn't what you wanted? If so, was there something wrong with the description of it?

    It doesn't matter how the seller went about ordering/delivering the item, (if) the OP ordered/purchased the item in store so didn't make exclusive use of distance means. The DSRs do not apply.

    B&Q have a 45 days return policy anyway, which OP was well within.

    Are you sure about that? I don't think the OP has said when they bought it. The OP says they agreed on the 12th to collect it. Today is the 11th? The OP needs to help themselves by finding time to be there for the collection.

    Firstly B&Q do have a 45 day return policy, faulty or not.

    Secondly, I wouldn't have purchased the sink had I been able to see it in store as I would have known it would be unsuitable due to the way in which the doors opened.

    Thirdly, I contacted them initially on the 12th JUNE and twice subsequently to try to arrange a collection. I was assured on the 12th JUNE that it would be collected within 28 days and I would be refunded within that time also. My OP is dated the 11th JULY, over 28 days later. I was told on my last call to them that someone would call me back the next day and no one did. To date I have not received any call from B&Q.

    I also shouldn't have to pay to have someone in my house whilst they collect. They had at least 28 days in which to collect but they never attempted to. They never even bothered attempting to arrange a collection and nearly 2 months down the line they still haven't. Well unless you count the text message I received stating they were to collect a couple of Mondays ago but they never bothered then either??

    Lastly, I took it back to store without any issues at all. Why staff on the phone told me I couldn't, on two separate occasions, I have no idea.
