Parking Eye - Canvey Island

Hi, I'm after some advice. Please accept my apologies in advance, I'm new to this and it has taken me best part of an hour to register and find out how to post a message on here.

I have received a PCN from Parking Eye last week after visiting one of their car parks. The terms of the car parking facility are such that you either pay and display or you register your registration number if you are using the local facilities. I parked with the intention of using the cinema facilities but whilst in the queue one of my elderly parents (who is registered disabled) became ill and had to leave rather quickly. The car was parked for a mere 15 minutes and of course it didn't dawn on me to get a ticket (as I said, you don't need one if you are using the facilities which was the intention).

I have responded to Parking Eye to explain and given my mother's distability details should they wish to follow this up. I'm a little conflicted as to what I should have done and what I should do next after reading so many posts.

I did try to scan both letters but I don't seem to be able to upload on here for ease of reference.

Any advice would be most appreciated.

    You can't post full working links yet and in the case of Parking Eye it's best not to identify yourself with pics of the letters, as they read this forum.

    You just need to wait for the rejection letter and POPLA code and then write a humdinger of a POPLA appeal. Hope you didn't admit who was driving (bad move).

    To pursue the charge is a breach of the Equality Act 2010 but you have to spell it out for POPLA as they don't get it unless you slap that law in their face!

    Thank you for responding to my post.

    The letters I was going to upload have all be redacted so that my identification would have been protected but thank you for the heads-up about this site being watched.

    Unfortunately I have admitted that I was driving and therefore parked the car but as previously mentioned there is no requirement to obtain a ticket if you are using the facilities and seeing as we were in the facilities queuing when the incident happened I didn't see the necessity to obtain a ticket when exiting after a mere 15 min stop as we were rushing to get home. At best, I would have thought they would have chased for the sum of the ticket and perhaps a minimal fee to cover administrative costs, not £100 fine.

    I'll wait to see when I receive a response as to whether they provide this POPLA code and take it from there. How long does it normally take to receive this letter?

    You could also try contacting the cinema and see if they can get it cancelled for you. You might have to push them as they will probably want to fob you off to the parking company but if they can quash it now it will save you the hassle of an appeal.

    Unfortunately Parking Eye won't accept the cost of the parking ticket plus a small admin fee as their business model is based around frightening people into paying large "fines" rather than recovering reasonable fees for parking.

    PE should acknowledge your appeal within 14 days and decide it within 35 days (but can take longer in "exceptional circumstances").

    It's not that they would be 'helping' - they should be apologising when you explain about your mother's disability and illness. Do not ask nicely(!!), you need to take the fake ticket with you and call in person to speak to the Manager only. Be assertive about this scam.

    Tell them they (the cinema) are liable for disability discrimination if no 'reasonable adjustment' (under the Equality Act 2010) is made by them or their parking agents. They are responsible for the actions of their agent (unless the PPC is contracted by the landowner not the cinema, in which case require the cinema to give you the contact details of the person responsible).
