Smart Parking and land ownership

Hi everyone, basically i received an 'invoice' from Smart Parking for parking in a restricted area round the back of Asda in Greenhithe.

When i say restricted, it's a small area where taxis can wait and supposedly buses stop there because i haven't seen one yet.

Not that it really matters for my case, but cars wait round there and occasionally park for convenience, i'd imagine. I was only parked there for about 10 minutes, along with the majority of other cars parked there, but as i was closest to the door i guess this is why i was done over first!!

Anyway, i went in to asda to ask them to confirm if they own the land and surprise surprise they said oh its council owned. I challenged this because surely if it was council owned i'd have one of their own official tickets?

I've read on here about Smart and Parking charge notices, POPLA the lot, i just wanted to hear if any of my circumstance would differ from disabled bays as an example or if anyone knows that this particular area of asda in Greenhithe is in fact council owned?

    Highly unlikely. ASDA routinely LIE about this, and it's shameful that this incorrect information clearly must come down from on-high in order to this FALSEHOOD to be so widespread.

    Smart parking are Asda nationwide scammers, so they own the car park. Their lies are breathtaking sometimes, its so easily shot down in flames by going to the land registry for a few quid. But I wouldn't bother just go straight to their head office and make a complaint there, tell them you are a customer and getting ripped off by their agents is despicable. Also go to their Facebook page and make complaints there.
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    ASDA instruct their staff to LIE to customers with regards to car parking disputes.
    just another way of them showing you how much they value your custom, not happy with conning a weeks shopping money out of them they do not even have the decency to pay you the basic respect of telling the truth.
    They think it is one big joke and letters of complaint sent are treated to absolutely no consideration, are filtered out at the head office in and skipped.
    A small dickie bird told me they do save the odd one for a good laugh.

    You could also confirm with the council if they own the land, its always possible you foiund the only honest staff member.

    I rather like the Lidl approach where customers are told that Lidl are prevented from cancelling parking charges due to BPA regulations. But I guess telling them it's council land works too ;)
  • Post code for asda is DA9 9BT and it falls under Dartford Borough Coucil.
