Right forum?? Will I Need Planning Permission

Hopefully some kind person might have some ideas. I have a new home which is on a hill so that the garden runs steeply downhill.
There is a small existing concrete balcony and then steps down to the garden (quite a lot of steps). I wanted to extend one side of the balcony with decking to make a useable space for eating outside (you really wouldn't want to be carrying food down those steps).

I looked on the government site and it says for raised decking areas you need planning but not for those 30cm above ground. So here is my question...from the level of the house is it not raised but runs out at the same level, but obviously from the garden it is raised.

To be honest I hadn't even thought it would be a problem so bought the decking (not a massive area by the way) but the neighbour next door has said I would need planning permission.

Any views would be greatly appreciated. I am psyching myself up to phone the council but am worried. Many thanks

    technically yes, as the decking would at some point be higher than 30cm from the ground level. if you didnt want to apply for planning permission you could always take your chances and build it anway and hope that the planning authority never find out about it but that would depend on how beaky your neighbours are and whether they are particulalry clued up about planning. if they are likely to call the council's enforcement officer out you'll be faced with either making a retrospecitve applicaiton or having to take it down.
