Samsung galaxy s4 carphone warehouse

My dh pre ordered a s4 on a 24 month contract paying 49.99 for the phone he received this early may 2013.
By June 24th the phone was turning off and not able to be turned on. He returned it to carphone warehouse who sent it to their repair centre.
The phone was returned 8th July with a note saying there was a problem with the battery board and it had been replaced and repaired. After two hours the same fault occurred.
Dh returned to the store who said he would need to contact the repair centre. They have advised he can have a samsung note 2 (apparantly a different phone) or he can claim on his insurance.
Are they correct? I was under the impression he was entitled to a replacement as the repair did not work.
Any advice would be much appreciated. Thank you for taking the time to read through.:)

He's entitled to a repair, replacement or refund.
Really, I'd say they should be offering a refurb S4, but be careful, as they may just offer a refund of £49.99.
You could try emailing the CEO at CPW as when they monumentally cocked up for me the CEO's office were great!0 -
Thank you for your reply. He is going to contact cpw today and see what they can do.
Do you happen to know if he were to get a refurbished phone whether it would carry the same guarantee if things were to go wrong again? I.e should the same or another fault occur would it be repaired?

In other words, you don't get a new guarantee when a phone is replaced.
If the original guarantee had expired, then you may get a shorter guarantee, say 3 months, with the refurbished item.0 -

Great! Thank you, I was just a little worried as his phone is fairly new and should anything go wrong with the refurbished one I didn't want this to not be repaired. He is waiting to hear back from them so fingers crossed0

If its the 8gb version, dont expect it to be much good.0 -

Yea galaxy S4 is full of bloat wear, have a look at the HTC One you will be impressed.0 -
