Asda / Smart Parking / Blue Badge

I was in a store last week when they received a call from a blue badge holder about the not so smart tickets they were receiving.
The site had put the bb holder on the white list, confirmed by not so smart but who said, and I quote,
"We know the driver is on the white list but we are still waiting for Asda head office to confirm it. I have the letter here in front of me ready to sign confirming the driver is exempt."
In the meantime not so smart are happy enough sending out anpr generated tickets from this site.
I'll post up some piccy's at the weekend from this particular site and you'll see why ALL tickets are null and void.0 -
The ANPR is set to generate letters from the back office system as soon as it resolves a VRM that appears to be outwith the set parameters. No human makes a 'decision', so it remains junk mail especially if the Parker did not agree to the terms.0

and here's a complaint I wrote for Aldi about a disabled 'overstay' fake PCN:
My posts on pepipoo show my username as SchoolRunMum. Your brother's driver is allowed extra time to park under the Equality Act 2010 and this legal right isn't suddenly removed if Asda haven't bothered to draw the car registration thing to a driver's attention (Asda's fault):
Print out that link and take it in to Asda with the fake parking ticket and copy of the Blue Badge speak only to the Store Manger. Only leave when it is cancelled and when the car registrations that transport your brother have been PERMANENTLY added to the store's white list of exempt numberplates.
Hi Coupon-mad - Thank you very much for that - very useful.
To update: I popped into Asda last night and spoke to the Duty Manager. The annoying thing is that I work in London during the day and could only go in the evening. I imagine the store manager only works in the days. I am also not ready to send my mum in and cause her more stress.
The duty manager was very unhelpful and nonchalant. She said I shouldn't have been given it but that she couldn't do anything. She said their cameras can't pick up the blue badge and so I must write to SP. I said I had read cases like this on the Internet before and that store managers had cancelled. She said they are not allowed to do this anymore due to "the new system".
I am unsure if the actual store manager will be any more helpful if this was her attitude? I asked for the head office number + address.
I am now considering a couple of options:- Calling the Asda head office and complaining directly to get it cancelled
- Appealing the ticket via SP and, if they are silly enough to reject, going to POPLA
In either case I will be writing a letter to complain about her attitude.
Any thoughts on this approach please?
Thanks you all.0 -
I'd go for the jugular were I in your position. Have your mother write a formal Letter Before Action to Asda (at their registered address, not your local store!) describing the circumstances, telling them that you hold them liable for the actions of their agent Smart Parking, that that they are in breach of the Equality Act 2010, and that you demand £500 compensation for injury to feelings. And if you don't get it within 14 days you will file a claim in the County Court.Je suis Charlie.0

Very poor customer service. What she meant was...I said I had read cases like this on
the Internet before and that store managers had cancelled. She said [STRIKE]they are not allowed[/STRIKE] can't be bothered to do this anymore [STRIKE]due to[/STRIKE] and I'll make up a feeble excuse and blame it on "the new system".0 -
Especially as the people who work at ASDA are not classed as "employees" , but as "colleagues" which to my mind implies that everyone who works there has some say in how the company operates. If so, then they should also have g some "empowerment" enabling them to make decisions themselves without referring the problem upwards to higher management. What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

I have to say that like the idea.
But sadly this is exactly the kind of thing I didn't want to do... I don't have the conviction or the time I am afraidand I just don't want to put my mum through it.
She has so much on her hands as a full time carer as it is. Sorry to sound defeatist - I just want this entire sad story to go away as it is very stressful. Thank you though.
FURTHER UPDATE I have rung the number which I was provided with last night. I was told by switchboard there is a person "that deals with PCNs" at the head office. I have left a message on their voicemail as they were away from their desk. I will await their response. If I am honest I am not holding my breath. I will try and write my appeal for SP as well.0 -
Writing the letter doesn't oblige you to take them to court, the point is to get their attention rather than a brush-off. The likeliest result is that they will reply stating that the ticket is cancelled and they are sending you some flowers or vouchers or some such.Je suis Charlie.0
