My daughter (older one) got married a few years ago to a man from kosovo and they signed papers in his country and did a register office thing here but they separated and now she wanbts to divorce him. she checked and also her solititor checked and they said that the register office said she was still married but her husband had put in an application yto divorce her but it got turned down as he didnt have any grounds. So she is divorcing him. But then he was on the internet saying he had just got married and he has a picture with him and a bride and he said that he got the papers cancelled in his country so hes divorced her already.
Can this happen? Can she be divorced wihtout knwoing? If the england register office says she is married can another country say she isnt? Is he a bigamist?

Has your daughter told her solicitor about the marriage? Where were they married? In his country or in UK?

So first marriage was abroad.
no divorce granted in uk, but possibly granted in the country they got married in?

Yes thats possible and he wouldnt necessarily be a bigamist.
eta ~ sorry didnt read the OP correctly ~ they had a legal registry office wedding here in the uk? not just a blessing? i,d say then that he is still married to your daughter as he had a legal ceremony of marriage in the uk with no corresponding divorce.
does he intend living in the uk with his new wife?0 -
they got the marriage done here first and then went to his country and did it there too and it was a marriage not a blessing and it was registered as them being married here in england. And he did pout in for a divorce here but he had not grounds so they said no and her solicitor said she is registered as still mariied. I dont know where his new marriage was as it was in the paper but didnt say where they got married. They live in the UK yes as he works here.
He might have got only married in his country to the new wife.
My daughter solictior says she will have to look at laws in both countries. My daughter has not had share of any of the flat or money or anything and is worried she wont be able to if he has somehow divorced her wihtout her knowing. She needs to go and have a whatif discussion with her local police.
She does not need to make a formal complaint but she can ask them what if he married here, has been refused a divorce here and marries in another country? Is this bigamy.
I assume that he used the marriage to obtain a visa? Has she spoken to the UKBA about the situation?If you've have not made a mistake, you've made nothing0 -

See this document for some help. Specifically look at page 12 which informs you about the validity of divorce that is granted in a foreign country outside the EU.

Especially worthy to note this
Recognition may be be refused if the divorce was obtained:
1-without such steps having been taken for giving notice of the proceedings to a party to the marriage as ... should reasonably have been taken”
2-without a party having been given (for any reason other than lack of notice) such opportunity to take part in the proceedings as ... he should reasonably have been given
3- there is no official documents certifying that the divorce etc is effective under the law of the country in which it was obtained
4-where either party... was domiciled in another country at the relevant date, there is no official document certifying that the divorce etc is recognised as valid under the law of that country0 -

. But it would only become an issue if you wanted to marry another Turkish citizen in Turkey. 0 -
