Trading Standards issue - CAB website

Hi

My mother needs to complain about a builder repeatedly not turning up.

Is this a valid case to pass to Trading Standards?

If so, does my mother need to log it herself, or can I fill in the Trading Standards contact form on the CAB website with my contact details but explaining in the text that it's on behalf of my mother?

    Meanwhile, re the issue itself, apparently she has been advised to tell the builder he must turn up on the new date he has given - 16/07/2013 - otherwise she will get a new builder and get the first builder to pay. She has already paid the first builder and apparently he is now in breach of contract. Apparently he has responded to this and says he can do 18/07/2013. Does my mother need to accept this?

    Does your mother want to accept it?

    For the sake of two days (compared to having to find a new builder) I would accept it on the understanding that an immediate refund will be expected if he lets her down again. If she has already lost confidence in him, I would say no and ask for a refund.

    Suggest she does - but needs to make clear that there will be no waiver or further compromise dates.

    She is then seen to be reasonable in resolving the issue. TS will do nothing that will help her directly, so only of use to help in a general way.

    Thanks for the advice. I am thinking we just need to send a letter of our own by recorded delivery, ie no need for solicitor's letter. Is that right? I have sued for Small Claims in the past elsewhere anyway.

    Why would you want to involve a solicitor?

    Are you planning small claims court action?

    They tally with each other and advice we've received elsewhere, however that other advice also suggested sending a solicitor's letter to confirm that work must start by 18/07/2013. I think a solicitor's letter is a bit drastic so I am sending a letter of my own instead.

    Can I suggest you express yourself a bit more politely please?

    I think you missed the point, the OP suddenly mentions a solicitor letter in the middle of a sentence. Asking for advice on it. Naturally this raised a query for more information which seems to have upset the OP.
