Hi there,
I will cut to the chase, i droped a friend off and now have letter.
All i can find on here at present is cases that date pre 2010 or cases with people who have Disabilities, thus have a better case than me.
all the old info on this subject seems to say - do nothing and let it go away, i have watched the watch dog clip etc, but now the law has changed i assume i have to write a responce.
as its now day 14, i excect i have somewhat missed the boat.
can someone give me some real advice or i am just going to pay the £40  as i am not sure i can deal with all the hassle.
( i know that is what they want you to do but its fine i just will not go to Luton any more as this is just stupid)

It's almost 12 months since the law changed - but that actually changed very little other than the fact that if the parking company can't find out who the driver of the vehicle is then they can chase the Registered Keeper instead.
You say you've been reading threads from 2010 - jeez, that's 3 years ago. There are zillions of newer threads, look at the first page of the forum and see how many there are there.
One option is to ignore - and hope it goes away. But if you had read anything from the past 6 months you'd realise that isn't recommended any more.
The next option is to fight it, but that will involve you in doing some serious research on the forum and putting in 2 appeals, 1 to the PPC and then 1 to POPLA (both with help from the forum).
You say your 14 days is approaching - what happens at the end of 14 days?
Which PPC is chasing you?
Can you give us a timeline of when the parking event happened, what date does your first letter have on it and when did you receive it? Any other letters from the PPC?Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

hi there,
APCOA are the company noted at the head of the paper.
The date of issue of this notice : 26/06/2013
The date i pulled over is : 15/06/2013
after 14 days it goes from £40 ( which if i had to i would pay) to £80 ( which i would not pay and would stand and fight)
This is my first letter.0 -

This is my first letter.
If you're going to fight, then there's help from here.
A thumbnail of what needs to be done is as follows:
1. Check paperwork for compliance with PoFA and BPA Code of Practice (see ** below)
2. Soft appeal to APCOA to get a POPLA verification code
3. Appeal to POPLA
** Does the letter (Notice to Keeper) specifically identify 'the creditor'? Words to the effect 'The creditor is.......'. If the word 'creditor' is mentioned, type up exactly what is written about the creditor please. If the NTK is deficient in this regard we could fire something off quickly to try to knock it on the head soonest. If not.......
....... there's work for you to do. Have a look at a previous post of mine which provides a number of links to help you understand the steps above.

Just put the word 'Luton' in the 'search this forum' heading on the right above the thread list on the parking forum. Change the default to 'show posts' instead of 'show threads' as it gives a more specific result. I have posted two 'first challenge/complaint' letters up re Luton in the last week at least, all the same stuff that you can use.
We have typed replies only this week about what to say in a a challenge letter, and for goodness sake who cares about the 14 days on a scam PCN that you will not be paying (there is no 'discount' bribe if you are going to pay zero anyway). Really have no idea why anyone even looks at that 14 days thing on a scam fake PCN!
Please do try this search and read other recent Luton threads as we've all typed out replies so many times recently...PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
