Land ownership question (driveway owned by builder)

Hi all, I am looking for some help as my house is on the market and i have discovered that one of the parking spaces on my drive is owned by the builder that constructed the house back in 1995.
Apparently this is a common trick by this particular builder in the area, he uses it to generate extra income as most people pay a vastly inflated price for it (around £5000) Now i have lived in the house for 8 years and always used the space as we have 2 cars (to our knowledge he has not used the space since 1995), is there any precedent in law that if the builder has never used his space and it is surrounded by land we own that we can claim it is ours?
I would appreciate any advice at this stage as i don't want it to become a issue with the sale of the house.

Have you paid any money to use it, or acknowledged in any way to the developer that the land is theirs?0

Have you actually checked the deeds of your house to make sure the land is not yours? Assuming you're in a normal-sized house, as opposed to a smallholding with complicated boundaries, it would be an absolutely massive ommission by your solicitor if it really was the case that part of your driveway is owned by someone else. Just out of curiosity, does the builder have a right of access across your land to get to "his" space?0
