Euro Car Parks

Got a fine in a Euro Car Park for not displaying a ticket correctly.

Girlfriend put it in the back window instead of the front.

I have the ticket.

What should I do, as I have paid for the parking but now have a Parking charge of 60 going up to 100 (if not paid within 14 days)

    It's not a fine, it's an unenforceable speculative invoice.

    Write back to them:

    Re your speculative invoice no. XXXXXXXXXXX, the keeper denies all liability for this charge on the grounds that the parking was paid for (copy of the ticket enclosed) therefore you have incurred no losses and your alleged charge constitutes an unenforceable contractual penalty.

    Should you wish to pursue this matter further send me a POPLA code per the BPA Code of Practice. Please note that (i) failure to comply with a code of conduct to which you have committed would be an offence under the Consumer Protection from Unfair Trading Regulations 2008 and (ii) failure to issue a POPLA code withing 35 days will indicate your acceptance of this challenge.

    See above. Worth checking if signs say where ticket should be displayed.

    Also, in accordance with BPA and POPLA guidelines, ask for photographic proof.

    And was car parked so rear window was easier to see than screen?

    thanks the response.

    If I write to them they have the R.keepers details,so they wont have to pay for them. I am more interested in just getting out the ticket so I guess it doesn't matter they get my details for free....

    Do not contact them until you get the Notice to keeper. It's not clear if you have had only a windscreen ticket or follow up NTK.

    Do you intend to pay? If so, thanks and goodbye. If not, then why contact them now when they have every opportunity to screw up their paperwork in their NTK.

    If your appeal to them is successful, then they will cancel it whether within the 14 days or not.

    I understand, yes it's only a windscreen ticket I have.

    I have not had a NTK yet (only got ticket this weekend)

    So hang on till the NTK and come back for help. Keep track of the various dates and look up the wording requirements and timescales on POFA212 and BPA.

    You will find them on the BPA web site code of practice that also has the POFA relevant section.

    Although we have a decent generic set of appeal points, if you can check out the requirements for wording on the ticket and NTK for failures, then that is even better.

    Any reason why gf put ticket on back screen and, if you go back to that car park, check wording of sign re where you can display ticket.
