Back dating

Hi folks,

Well I attended the tribunal and went well :):j:j

Now...

I know Carer's Allowance can be backdated 3 months. But will other premiums be backdated to October last year?

I was on Income Support until March where this changed to support ESA.

So will I get all the premiums of income support from October to March, the ESA premiums from March to present? Can these payments go way back to October?

The tribunal never mentioned the Atos medical and questions were posed from the Doc and disability rep on the panel. Just wished they skipped the Atos and asked directly. Partner was in with me but questions only addressed to myself.

    Yes, your ESA rate will be the same as what you received when you were on IS, and it will be backdated for the whole period.

    I wondered if somebody could run through some figures with me?

    I am leaving out low rate mobilty as been getting this. As of 08 October last year the tribunal ruled middle rate care.

    From the 08 october to 12 March was getting Income support with partner on claim. From 12 march currently getting support ESA.

    now.

    DLA middle rate from 08 Oct to 04 of this month is £2022.15

    As I was getting high rate care bearing in mind Carer's Allowance not in payment as can only go back three months. So I think I would be entitled to Severe Disabled prem on Income support rules which from 08 Oct to 12 March which is £ 1547. As well as this entitled to the another prem which between the dates is £1060.80

    Know in ESA.

    A month Carer's Allowance still not in payment due to three month rule makes that a prem of £238. Carer's Allwance then kicks in and carer's prem added which for three months is £399.60


    Is this correct or need more information? Driving me nuts this but am not putting trust into the DWP. I like to know things and this is one. My partner/carer is telling me to forget it but if am right thats £5 thousand pounds!! Such a high figure has got me doubting myself.
