esa are there any fair medicals

are they such a thing?
i won my tribrunal in june last year for the process to start all over again that time the nurse that gave the medical said you have m.e im giving you 0 points and he did
but i won my tribrunal :T
i have m.e and af and on top poss sinus problems to causing other problems i have had it since i was 21 and im 36 now wish they could feel like i do and see what they feel like :mad:
well this medical they have gone 1 better
i apparently if i cant walk get in a electric wheel chair or scooter
i have never owned 1
and the lies go on and on
i apparently do lots of gardening, i said i sat in a chair and filled a hanging backet for mum as im try to do things, this emplies i do digging and all sorts of physical things
i apparently do all the shopping when i stated in my origonal form mum does all this and told her the same
where do they get there lies from
so my moneys stopped too
this has really up set me when people in the waiting room said you will get 0 as you made an effort and washed and are polite
they said you need to be dirty smelly , wear odd shoes or carry a stick,
i was told to use a stick as my left leg is numb on the out side from sicatica but me being me would rather try and be normal, although i did say in my form
see to my like the real honest people are getting hurt and the people that know what there doing are still getting help and more on top
im so angry and up set why lie about every thing i said and twist things and add things i dont even own or have

I'm sorry you have had such a poor experience, but many thousands of assessments are completed without any problem - however it is only the bad ones you hear about.
The suggestion that you should turn up smelly and unkempt is ridiculous, it certainly will not get you more points. You should dress as you do on any other day.0 -
thanks hoping to lodge my appeal tomorrow if i can get hold of some one but i dont under stand why she could be honest and say what i said as its like reading a report for some one else the things i can appernetly do0

You get liars in every walk of life I'm afraid. Some will suggest it is done for financial motivation, but I think it is more laziness - they want to get the reports done as quickly as possible so just write anything
As the inaccuracies are so blatant I would also put in a complaint to ATOS, and possibly to the assessor's professional body. The chances of them being 'sanctioned' in any way, but if there is a pattern of complaints someone may take action against them.0 -
Fair assessments? (they aren't medicals as such) I don't know, I do know that mine was distorted beyond reason.
The HCP focused on a range of ailments that had absolutely nothing to do with my claim, and got extremely agitated when I insisted that he concentrated on the conditions I had listed on the ESA50, which were COPD and involuntary loss of consciousness.
Involuntary loss of consciousness on a regular basis if proven, carries 15 points. I had submitted clear and compelling supporting medical evidence. I was subsequently awarded zero points by the DWP and took the case to appeal which I won.
It's clear that in my case both the HCP and the DWP DM ignored medical evidence, the HCP gave a description of events during the assessment that bore no resemblance to the actual event.
There are plenty of examples on various forums of similar cases. The system is deeply flawed if it's only at appeal stage that medical evidence is considered properly.
I'm not suggesting all assessments are conducted in this way but in my opinion, one is one too many.0 -
Speaking personally, both of my ATOS examinations were as reasonable as could possibly be done with the limitations of the process.0

i have only had one assessment ( i was re awarded without the need for a second)
i was asked lots of questions that werent relevant to my condition ( blindness) but the HCP has to work through the assessment just as we fill in the ESA 50 .... some parts are more relevant than others.
it is only ever the 'bad# experiences that are highlighted, and while these are very stressful for the people involved... are very much in the minority0 -
...next time don't tell them you fill hanging baskets.

i filled 1 and mum put the compost in the basket and lifted it but i did tell her that :eek:0

I have filled out 2 ESA50s. The first one I was called for an assessment. Brand new purpose built centre with parking a few feet from entrance, all on ground floor. I wasn't kept waiting, and was not observed while I was waiting (no sign of cameras, reception desk out of line of sight of waiting area and person walked ahead of me, not behind).
I was in the room for 1 hour and 5 minutes with a qualified nurse. She listened to everything I said and skipped most of the physical exam as I had recently had surgery. After the many articles I had read on Atos I was pleasantly surprised.
The arrears of my ESA money appeared in my bank account on Friday and I received a letter on the Saturday confirming I had been awarded ESA and placed in the WRAG. I got a copy of the report to compare with the assessment and it was, as far as I can tell, completely accurate.
About 9 months later I received another ESA50 to complete. I took time to complete it and I explained in great detail how my various medical conditions affected me with respect to the descriptors. There was nothing I left out, it was a work of art!
I had a letter 2 weeks later confirming my ESA in the WRAG, no face to face was needed. That was nearly a year ago.
I am due to retire in 18 months, maybe that had something to do with it but I think it is important to let people know that not everyone has a negative experience. I confirm what Nannytone said, it is usually only the people who have a bad experience that bother to write about it.
