Barclaycard ppi claim rejected

please can anyone give me some advice regarding a PPI claim with barclaycard. I have submitted two claims for mis-sold ppi, one to Mastercard and one to Barclaycard. It appears that both PPI policies were taken out on the same date feb 1996.

MasterCard have agree to uphold my complaint and have offered me a small amount of money back, however Barclaycard have refused my claim. how can they agree to pay out on one and refuse another? I have sent them copies of my statements back to 1996 and have requested a SAR report, but I have not received this yet. I have written to them requesting they re-open the case as I really don't want to wait ages for FOS to sort it out. Aparently Barclays have said that at the time I took the policy they were following the correct procedures!

I was made redundant in 2003 and never claimed on the policy which clearly shows I was not advised correctly.

anyone got any advice please ?

    Because some will make an auto payout without investigation because its a small sum of money.
    If you ask them to re-investigate they can take as long as they about it, so expect to wait a few months[possibly]
    If they have said they were follwoing the correct procedures, what was your complaint basis? When did the barclaycard finish?

  • The MasterCard letter stated that they were unable to confirm that the policy was not suitable or adequately advised so they agreed to uphold my complaint. however, the Barclaycard refused the claim as they believe I was not missold. when telephoning them they said it was because the policy per-dated the regulations, however surely that still were obliged to advise me better on the policy, I.e I was advised that I would stand a greater change of suceeding in my application if I agreed to the PPI. they can to their conclusion without receiving my questionnaire and it crossed in the post with their letter of refusal.

    the ppi policy was cancelled around 2007.

    You had the weakest complaint of all. You can't prove you were told this.


    You're only next step is to refer it to the FOS if you want to take it further, but think about any other reasons why you would have been missold it, that you could afford the payments in some other way, either with insurance or savings.

    So you bought your card in the bank itself? Or over the phone? For you to have been told this I mean...

  • Is asthma considered as a pre-exisiting medical condition? should I write to them to add this to my questionnaire as they have sent my claim to the re-open team. Do you think it would assist my claim?

    I would be surprised if asthma invalidated the ability to claim on the policy in any other area unrelated to asthma. Unless it is particularly severe, I cant see it having any impact.

    Typically, pre-existing condition complaints tend to require the illness to be severe enough to make the chances of a successful claim on the policy unlikely.

  • I know I would have used inhalers and in the past have had steroids too for the asthma, I may have had the odd day of work due to it but it is a long time ago.

    So basically, nothing in your history to suggest it would invalidate the policy.
    So would you recommend me writing to them to advise them?

    Can't see any point as its not severe enough.
