Persimmon - Sales Advisor giving incorrect information

Hello there

I'm after some advice please.

I've bought a new build property from Persimmon (I know - lets get past that!) and to be honest, everything has been pretty straightforward and easy. Up until today, I couldn't have recommended them more.

We've exchanged contracts and are due to complete at the end of the month.

I've made repeated visits to the site every week and have enjoyed seeing the progress of the build. .

There is a huge tree at the back of the property and all the way through the buying process I was told that the plan was to remove the tree as it clearly overhung into my garden and blocked out all of the light. Each week I've checked on what was happening with the tree and when it was being removed. Each week I've been told that it's still the plan to remove it but no actual plans had been made.

Today I was asking the same question to the relief sales guy (the regular guy was on holiday) and he advised me that there were no plans to remove the tree. This was then confirmed by his manager on a call.

I feel like I have been completely mislead and lied to.

My question is what recourse do you think I have?

Thank you!

If it poverhangs onto your garden you can trim it/ask the management company to trim it/counil to trim it.

Is there a TPO on the tree? You may need to contact your local council to find out.

The plans should indicate if the tree is there or not, or planned for removal

And you would have been asked to sign those plans.
