I guess it's the receipts that did the job. A pattern is definitely emerging.

Certainly worked for the person I was helping (off forum - and the sole reason I initially started reading the forum and later began to contribute. Never once did I ask any specific question about 'my' case, but read and learned. Newbies - it can be done without direct help).

Well done OP - glad you've got the carp out of your life.
There is clearly a secret clause in the contract with some retailers that forces PE to cancel their charges when the motorist can prove that they were a 'genuine' shopper. It doesn't help those who cannot provide receipts because they paid cash or perhaps just spent a long time in B&Q discussing a new fitted kitchen. The fact that this 'Get Out Of Jail Free Card' is not mentioned either on the signs in the car park or on correspondence with PE just demonstrates how deceitful and underhanded they are.

And it's at this point the fundamentalist in me takes over - why should genuine customers have to beg and grovel to PE with receipts and bank statements to get rid of a penalty charge that should never have been issued in the first place?

But then the pragmatist returns ......... :).

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

It seems to be a common clause that PE are forced to cancel charges for 'genuine' customers as you can be damn sure that they aren't doing it out of the goodness of their heart when it's costing them £100 per time.

Thanks for reporting back on the outcome - it is good to get feedback, as it helps us to help others.
