ParkingEye Charge Notice - Hire Car

Hello Everyone!
I am new to MoneySavingExpert.com and I have been recently looking at related threads regarding 'ParkingEye' & 'Private Parking Charge Notices'.
Anyways I will now explain why I have came here today!
In May 2013, I apparently visited a ParkingEye managed retail car park whilst waiting for my son to purchase a coffee. My problem is that I was visiting in a hired car and wasn't aware of a parking fee.
ParkingEye has obtained my information and signature from the Hirer.
Time in Car Park nearly 1 hour.
I as the driver never left the vehicle.
Below is some information about the car park I visited that I didn't know prior to researching when I received this charge notice.
Tariff
You can park for the first hour for just £1, and £1.40 for up to 2 hours. A 2-3 hour stay is charged at £2, and 3-4 hours is charged at £3. if you are parking for up to 24 hours, this is charged at £8.
Charges payable from 6am every day, including Sunday. There is no charge from 6pm, but the gates will be locked from Midnight until 6am.
Please note that all vehicles entering and exiting the park, will have their registration number scanned by an Automatic Number Plate Recognition system. Any vehicle not displaying a valid ticket will be liable to a parking charge as displayed on the signage on site.
I would really appreciate any advice or suggestions what I should do.

Okay did the hirer comply with pofa 2012 and just pass on your details? Or have they just forwarded this letter to you? Also have you checked the hire agreement to see if they can charge you for this, normally it mentions penalties and fines. Is this in England or Wales ?When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
We don't need the following to help you.
Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

1. Confirm to the hirer that you are taking full responsibility. You are probably ok, but just to make sure that they don't pay anything.
2. Send a generic soft appeal letter - there is a variation of a soft appeal on just about every contemporary thread - and then make sure you get a POPLA code. Something like
Name
Address
Date
Dear PPC,
Your invoice xxxxx dated xxxxx.
The driver does not recognise your authority in this car park or your right to impose any terms, conditions or contracts on parking motorists, and wishes to appeal on that basis.
If you reject this appeal, I require within 35 days a POPLA verification code for me to appeal independently as per the requirements set out on the POPLA web site, further supported by the BPA Code of Practice.
You have been given the reasons for the appeal above. I have nothing further to add, and will not respond to any correspondence from your company unless it contains the POPLA code.
Be aware that there will be formal complaints to POPLA and to the BPA if there is no POPLA code on any rejection that you supply.

Yes they did comply with POFA 2012 - Schedule 4, Paragraph 9 (2).
Have you checked the hire agreement to see if they can charge you for this.
They have mentioned it but they haven't got involved as of yet anyway. We are going to notify the hirer which we know very well to not respond.

Stroma, They know it was us. As they gained the information from the hirer. I.e. the signed hire agreement.0

It makes no difference, don't admit being the driver keep it to the third party. You as the hirer could give permission for others to drive depending on your agreement, for example a spouse to drive, or if a lease anyone with insurance cover.

So you are going to send that challenge to the Notice to Keeper or Notice to Driver, now? Which is it that PE have sent directly to you now?
You do know NOT to ignore this now, that was old advice. Your challenge will lead to a POPLA code where we can help you win it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
