    The mortgage is outstanding by around £63K.....
    How much has a similar one gone for recently?

    We bought the house not knowing he was there as previous owner failed to declare on the buyers and sellers form.

    What did they fail to declare? Someone running a business down the road? If it was such a problem why didn't you see it when you viewed?
  • A bit of creative problem solving will get around the issue you're having with declaring your complaints.

    Step 1. Place house on market
    Step 2. Attend viewings with partner not present
    Step 3. Segue conversation into "why are you selling?"
    Step 4. Explain to prospective buyers that you love the house and love living here but your partner is a nightmare and gets very upset with the mobile mechanic, so much so they've filed a complaint about it and you just want your partner to be happy again so you're moving even though the mechanic doesn't bother you

    Then when the complaints are declared during the selling process your buyers will think "oh yeah, that's the crazy partners complaint! Not a big deal!".

    Magic.

    (note: doing this is immoral and I wouldn't recommend it...)

    We came round and viewed at certain times during the day early evening and weekends.

    However as we weren't aware that there was a mobile mechanic, we didn't know what to look out for!!

    Its a long story so wont go into it but to say the bloke is an !!!!!!!.

    Are you misunderstanding your obligations here?

    You do not have to inform the prospective purchaser of any hidden "problems" (unless they ask a specific question), only problems that escalate to "disputes".

    So if you had of noticed you wouldn't have moved in?

    Can anyone reference a court case where a case for non-disclosure of a dispute has resulted in a successful outcome?

    Got an estate agent coming out today to value the property.

    Basically, yes the vendor should have disclosed about the mobile mechanic 3 doors away, estate agent confirmed vendor should have so we might have a claim for non disclosure after all!!
