Dodgy Landscaper?

My neighbour has recently had a new fence installed at the back of their property - their old fence joined to mine and continued along the back of my property.

However, the landscaper who was installed the fence has put fence panels in which cover the width of next doors garden exactly, so I'm now left with a 1 foot gap between the fence running in between our properties and my fence at the back. My fence at the back is in a pretty poor condition so a strong gust of wind will probably cause the fence to fall down.

What are my rights here? The gap wasn't there before they took the old fence down...now it is!

    Maybe your neighbours fence was also in poor condition and they didn't want to risk it blowing down with a gust of wind.

    Who's property line did the fences meet at before?
    If there is a gap have they taken down part of your fence too?
    Have you spoken to your neighbours about it? Maybe they haven't realised there is a gap or could they possibly be having a gate added?

    Their fence was in a poor condition also, hence their reason for replacing it more than likely.

    If you imagine a fence panel supported by two posts, the post on the right is one foot in to my propery and the post to the left is around 5 foot in to their property. By removing this panel and placing another post exactly where the fence which divides our gardens are, and then building a new fence from this point in to their garden, I'm now left with a one foot gap.

    That changes things a bit, they/their landscaper had no right to alter your property, again I'll ask have you spoken to your neighbours about it? and do they realise what has been done? Who owned that panel?

    If it happened to me I'd be asking them to put it right, although if the rest of your fence is that bad then maybe now would be a good time to change the whole lot.
  • The above post has the right questions, ie who owned the panel and why were alterations done that affect your property.
    As you say though if your fence is in a poor state then now may be the perfect time to get it fixed up.

    I don't know who owned the panel - it could have belonged to any of the three properties which it was used by.

    I am minded to ask their landscaper to put it right - I haven't yet spoken to my neighbour. However, I am now considering replacing my fence also. It just pains me to have to do so since we weren't considering doing it anytime soon.
  • If it's as poor as you make out the autumn winds may not have given you much choice in the matter!

    Almost certainly not worth pursuing.
    Thinking critically since 1996....
