    Thanks will send both letters today.

    Had from the Echo going to do a story tomorrow.

    The post on the Range FB page I made has been deleted, have put another one on and that has now been deleted to.

    Ok just had my meeting with the Dorset Echo here's hoping this applies some pressure.

    Also had a reply back from the DVLA as follows:


    Dear Mr Martin,



    Thank you for your emailregarding the actions undertaken by ParkingEye



    I note you have advised that youdo not want details of your case to be shared. I should explain that DVLAcannot regulate the practices of private parking companies and accredits tradeassociations to ensure that those who request information are legitimatecompanies that operate within an enforceable Code of Practice. AccreditedTrade Associations (ATAs) have responsibility for ensuring standards aremaintained in the industry, so when we receive an enquiry or complaint relatingto the use of data by a parking management company, we will pass it to therelevant ATA to investigate.



    The relevant ATA in thisinstance is the British Parking Association. If you would like DVLA topass on details of your complaint to the ATA for investigation, please confirmthis and provide details of either a PCN number or your vehicle registrationmark. Alternatively you could consider the appeals processes set out onthe notice you have received or contact the ATA directly.



    I hope this explains theAgencies position in this matter.

    Yes. DVLA once again admitting that they don't do the due diligence on requests for keeper details that the law states they should. The usual bunch of civil servants trying to push responsibility elsewhere. They are as bad as the PPCs, and complicit in the whole scam.

    Maybe a reminder to them that the PPC has to show just cause for requesting the details, the DVLA is meant to verify that, and it's not for a 3rd party with a vested interest to be policing what the DVLA should be doing themselves. Maybe also remind them that the know the supposed accredited association has a reputation for not enforcing its code of practice, and so they should not be accepting membership of that association as the bar for gaining access to their database. In short, they are guilty of negligence.

    Not that it'll get you anywhere.

    Yes, you should reply:

    My personal details have been misused by ParkingEye Ltd. to misrepresent to me that I was liable to a charge as registered keeper of a vehicle when this was not the case.

    I am not asking DVLA to regulate anything, I am asking DVLA to peform due diligence before releasing such data and to cease releasing private name and address details to a company that misuses such data. It was DVLA that released my personal details to ParkingEye, not the BPA, therefore DVLA is responsible under the Data Protection Act and I must insist that DVLA now takes action.

    I am aware that DVLA has recently suspended a number of companies for misrepresenting keeper liability, how is this any different?

    I am also asking my MP to take up this matter with the DfT and yourselves.


    And do ask your MP to do so. I have taken up private parking matters with my MP in the past and she has been very helpful in pursuing the DfT and the DVLA.

    Did you send Broadsword's strong version of the email as linked, or a shorter one? If the latter then follow it up with Broadsword's wording and say you fear the have missed the point if looking to just pass the parcel to the BPA.

    Say that the complaint is about the DVLA as much as it is about the Operator.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
