Do I have to pay again ?

I needed an mot last week, so got it done.
I knew I needed a windscreen, exhaust box & cv boot.
Total cost 435. All ok so far.
When I rang to pay they said the bonnet won't shut proper, but they will deal with.
There was a note in the car saying bonnet shut but you need a new catch at some point.

I was driving to get my tax, when the bonnet shot up & smashed the windscreen, wiped out the aerial & bent the bonnet.

After I'd stopped shaking, I found the remains of a bungee in the engine compartment.

It took all my cash for the mot & tax.

Any help appreciated before I go back to the garage tomorrow.
As I understand the bonnet catch is a pass/fail on the mot, even though they said about it, it still passed.
Will they cough up ?
I'm struggling with mortgage & it took me a while to get the car sorted again, only to blow up in my face literally after 1 day.

    They should have never of let it out like that, they should never have let it pass its MOT.

    No doubt if they aren't forthcoming, you could take them to court.

    First thing I'd do? Report them to vosa. They could've caused deaths of people in your car, other cars, or pedestrians.

    I was doing 50 on a dual carriageway luckily a straight one, wife & kids were not in the car, only damage to me, new pants.

    Not the point could've been much worse.

    MOT Test of Bonnet Catch

    Reasons for Failure:

    A bonnet that cannot be safely secured in the closed position
    An excessively deteriorated, ineffective or insecure (bonnet) retaining device


    I'd go straight to vosa from what you've said.

    Was there any mention of the bonnet catch on the MOT advisory sheet?
    If so, you should make sure that you keep a copy of this as it will be evidence that the garage were aware of the problem.
