Comet, Hotpoint and Sale of goods act?

Hi all,

I'm posting for my Mother, she brought 18 months ago a hotpoint washing machine (ultima 740w) from Comet before it all hit the fan.

The warranty expired in Feb and today whilst using it, the drum lifter parts all came loose and rattled about the machine.

This is the second time its happened for her, first time Comet replaced it, now obviously they can't.
She phoned the hotpoint number who quoted her 200 pounds to look/replace the missing parts.

Surely under the sale of goods act, she should be entitled to some point of customer care but from whom? I understand that the sale of goods act relates to the retailer not the manufacturer but as Comet no longer exist who do you contact?

She's looking on Amazon and can see the parts for sale for a tenner to replace herself but surely she should have some sort of rights to repair her washing machine by professionals and not be charged a stupid sum for it?

I think she should be able to have it replaced or repaired as its not been used excessively - Family of three, washing mainly done in a day at the weekend.

Hope this makes sense!

Thanks for any help :)

You are bound by the manufacturers warranty. Any claim you have under the SOGA were against comet, not hotpoint. That disappeared when they went under.

So no, you can't really claim against anyone.

    Not strictly true.

If bought using a credit card then the rights against the card issuer are joint and several. Despite Comet no longer existing, the OP can (if the item was bought using a credit card) obtain a remedy from the card issuer.

Thee is that...I did however make the really terrible presumption, older person, probably paid cash/debit.

Unfortunately they charge excessive fee's, sufficient to cover the cost of the 'free' replacement parts.

i know they charge way over the odds for the call out , i found that out many moons ago when i had a washer that conked out within the 5 years parts guarantee, i got it repaired a lot cheaper by a local tradesman, but if the op has been quoted £200, the parts should be covered under the 5 year guarantee and hopefully even hotpoint wont charge £200 for a call out

They haven't said they will charge £200 for a call out, that quote includes replacing the missing parts, so it's labour inclusive.

apologies my wrong, i thought the op was being charged for parts as well as the call out for the £200.

If OP registered for the 5 year parts guarantee (and you do have to register), last time I recall, Hotpoint charged £105 for the callout
    Squirrel!
If I tell you who I work for, I'm not allowed to help you. If I don't say, then I can help you with questions and fixing products. Regardless, there's still no secret EU law.
    Now 20% cooler
