Parking owners statutory obligations

I could do with some feed back on this
I was pulling out of a car park as someone was turning in, it was tight so I moved over and............................... gnash.
ripped some paint of the car.
my car, the other car was ok.
I thought I had moved to close to a metal corner cover protecting a wall, but on going back there, I now see a lump of metal sticking out which is used to lock the gate too when the car park is closed.
Now Im thinking I couldnt /didnt see it when I was pulling out, So your the jury, do I have a case, would you like pics, and if nothing else for once I would like the car park rippers to pay me :rotfl:
oh the damage was £400.

Hmmm...your car was moving and obviously the object wasn't. So you are at fault in the situation you describe I think...but if that metal thing as sticking out a long way then you can also blame the car park landowner as it's dangerous/negligent, etc.
So my answer is, it's a bit of both but I think you need to write to the landowner first (after taking photos of the offending metal spike in its current position!). Ultimately, and the only way you might get a contribution would be if you sue them and you need pics of the evidence before they change it.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
