where do we stand
I just reserved a car over the phone for £500 on my credit card. we agreed a part ex for my car which was the same as a local ford dealer of £1000.
I was then emailed some forms to sign and return one was the condition of my car which I described as average I was never asked if it had been an write off
when I read the email it says they do not take write offs as part ex mine is a cat D
I phoned the dealer back and he says he must talk to his boss and will call me back, if they still wont take it will I get my deposit back as I didn't know they woudnt take it until I got the email and I believe the dealer should have asked.

There shouldn't be a problem with getting your deposit back. Is your car a popular one? You may find it quick to sell on Gumtree/Ebay and not worry about the part-ex.

They're hardly likely to be able to strong arm you into a sale when you are presenting an unsaleable trade-in to them (many finance firms blacklist cars on the register). More likely they'll huff and puff and refund you.0

there is no finance involved the car we were buying is £12500 I am paying £11500 cash plus the £1000 trade in.0

Off subject sort of - have you checked online brokers prices for the same car?
If they are cheaper you may come out better off.0 -

They would normally HPi the car routinely before agreeing a trade in price. Perhaps it's not as Cat D as you think it is?
If not, then an ST170 assuming it's not shot/a total dog is worth £1000 private sale, so advertise it on autotrader or pistonheads and you should get your money back, albeit in a bit more of a circuitous route.0
