I am claiming under the above act as a breach of contract occurred and Lloyds are jointly and severally liable. How can I write them an official letter stating this. They keep calling it a dispute which it is not. I am exercising my rights under the CCA 1974

Exactly what you said above............... If you want more detailed advice you need to give more details as to the situation.
Re: Dispute. probably means Lloyds are processing it as a chargeback, depending on the situation this may be easier and quicker than a Section 75 claim.0 -

Without any info on what you are talking about I can't say more than that.
All I will say is the last person that tried to force a S75 when chargeback options were available is still waitng on a refund months later. As well as having had to provide a lot of paperwork.
When a chargeback would have been resolved on the call and the refund in days.
Of course because he raised it in such a way that it was a complaint. If he took it to FOS/FCA he would not get any where as he refused to listen to the advise given.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
S75 claims are handled by the disputes team. I claimed against them last year. I did everything by e-mail (with scanned attachments of evidence) and found them to be very fast and efficient.
They re-credited the disputed amount in less than two weeks. They paid compensation for consequential loss in about 6 weeks. No arguments, no stress.
