Help please - small claims court

Hi all,

I'll try to be concise in my explanation of the situation.

My sister has raised a small claims court claim against her landlady for failing to return the £900 deposit on the flat she rented.

The defendant failed to respond to the claim within the 2 weeks allowed so my sister went for a judgement by default.

This was accepted by the court and my sister asked the defendant to repay the amount immediately.

After a week she had not recieved payment so she contacted the woman who claimed not to have recieved any documents from the court.

After another week still nothing so my sister asked the court for a warrant of execution which was granted.

She got a letter (well more of a little slip really) today from the bailiffs saying they had made contact with the landlady but she wouldn't allow entry.


What the hell is this! What did the bailiffs do, turn up and ask for the cash? Surely the whole point of the bailiffs is their ability, when instructed by the courts, to take goods from the defendant. Her car surely should have been parked outside. I am in utter disbelief and the little slip recieved does not give any help whatsoever about what the next step is.

Can anyone shed any light on this. What is the next step?

    AFAIK bailiffs cant gain entry to ur property unless you let them in.

    im no help with the question though sorry

    go back to the court - there are other options - ask for a charge on her property or an attachment of earnings on her salary

    The little slip she received would have been an interim return on the warrant. Each time the bailiff visits they send you a little report to let you know of progress. The debtor was probably out when they visited and they will make another visit. The warrant will still be live and the bailiffs will still be proceeding x
