Help with PCN

Hi, new to the forum but would really appreciate some help/advice/opinions. I recently got issued with 2 PCNs from Lambeth council for parking on a "waiting restriction during controlled hours".

The tickets were issued on these times/dates;

Saturday 25th May at 10:20am
Sunday 26th May at 14:11pm

The sign, that I will link to, states the following:

No Stopping
Sept - July
Mon - Fri
8am - 10am
2.30pm - 4.30pm
On School Entrance Markings


Please see the photos in this post. I challenged both PCNs via their website, explaining that I felt the officer had made a mistake, and showed them the sign and the hours/days that it listed. I received letters today telling me that "we do not feel that you have made grounds for cancelling the PCN". Now unless I am grossly misinterpreting the rules that were stated on the sign, then I can not understand how they have not cancelled these tickets.

Has anyone got any advice or opinion on if I am in the wrong here?

    You are on double yellow lines. You need to post up the photo of the parking restriction sign, not the school sign.

    Was it a PARKING Charge Notice or a PENALTY Charge Notice?

    The former are speculative invoices and easily challenged; the latter are actual fines and more difficult to challenge. If the latter then head over to the Pepipoo forums for help.

    Thanks for the replies. As far as i could see, this was the only sign in the vicinity, especially that could apply to the school zone that i parked in. It is a Penalty Charge Notice. Could a different parking restriction sign be relevant to this zone? I don't really understand how a different parking restriction could contradict and overrule the sign that applied to where i parked, or am I being stupid?

    I read that sign as no stopping is allowed on the school entrance markings on the dates/times shown. You are parked on double yellow lines - which means no parking is allowed at any time.

    It is 25 Daysbrook road on Google Maps. I see how you have read the sign, but the whole area that is marked as being the school entrance markings has double yellows. Google maps must have an older version of the street because the double yellows are not present, so I guess they have recently been added. This picture shows a much easier comparison to Google's view:

    Cheers my advice is this-

    There are double yellows behind the school markings going away from the junction. Double yellows without a sign means no waiting at any time. However you can stop on a double yellow line to let off a passenger and as there are no loading markings / signs you can also stop to load/deliver goods or can park for a period of time if you have a blue badge.

    The school markings apply as shown on the times on the sign. When it is these times it means no stopping at any time- thus nobody can stop to let off a passenger, disabled people can't park and you can't do loading at these times. However at all times the double yellow line indicates there is no waiting there.

    My only bit of advice would be to challenge the 2 tickets you have received. I'd say it is only 1 contravention and there should only be 1 ticket assuming you parked there and left it all the time and came back to 2 tickets.

    Ok thanks again for the replies. I have assumed that the sign i parked next to meant that the DYLs only meant no stopping on the times/days that were stated. I am now assuming that it means you are only allowed to drop-off/pick up people outside of these times/days. I guess there is no way I can successfully appeal with the argument that the sign are mid-leading?

    In regards to there only being contravention, and not 2 separate ones, I left my car there for 2 days and did not move it, can they give me two tickets for this? I am not sure how to appeal again, on any grounds, because they have just given me the option of paying a reduced rate in the next 14 days (one of which is incorrect, one is £55 and one is £65, even though both were originally for £110, reduced by 50% if paid in 14 days) or waiting for a Notice to Owner to have a "Formal representation. I have seen a lot of people saying that you can't be issued two PCN's on the same day, but one a day is very common and can not be overturned.

    Yeah that's how I see it. Personally think it was a tricky one to appeal but up to you.

    Not my area of expertise I'm afraid. However since it's double yellow lines and you only breached them once as they are active 24/7 and you stayed parked for 2 days I thought that is only 1 contravention. Happy to take advice from those who know better though.
