can someone help please, abit of a weird situation

UPDATE IN MY MOST RECENT POST


basically, years ago (1996), my dad signed up for a phone contract over the phone, during the days when people were still getting lots of calls with people trying to sell phones by phonesales. at the time he made the contract i was 15.

but he used my name but ever so slightly changed, so for the purpose of this we can say my name is Thomas Sawyer, born on the 1/1/1990

he used the name Thomas J Sawyer, born on 20/9/1965 - who wouldve been i think

now for yearss he was paying the contract as normal, then there was a dispute with the phone company over an bill AND an insurance issue at the same time recently, and as a result of that, he decided to stop paying for the contract. so Thomas J sawyer was recieving lots of letters and bla bla bla and just used to pass them onto my dad

I didnt really think anything of it, and quite frankly before anyone calls me an idiot for this, take note that when he originally got the contract, i was only 15, didnt really care much for that kind of stuff, and by the time i took note of the fact that Thomas J Sawyer was recieving mail at the house, he had already been using the contract without any problems for a few years. so again, i didnt really think anything of it.

anyway, i signed up to experian recently, only to find that it has 4 missing payments, with the phone company (This being the contract he recently decided he wouldnt pay anymore over an arguement with the company).

what im trying to get at is, what do i personally do about this, because the fact of the matter is:

I, ME = Thomas Sawyer, has never had a contract with said phone company

when the contract was made all those years ago - i was 15, i couldnt have possibly made a contract

It seems as though my dads ultimate intention is to have the phone company chasing a ghost, or someone who does not technically exist, while i dont agree with this, the fact of the matter is, i am not the person they should be chasing for the money, infact i dont really care about the money, my bigger problem is the fact that Thomas J Sawyers missing payments are showing up on my credit file. and the dumbest thing is, it fully has it noted on the file that TJS has a birthday which would make him like 25 years older than me.

what do i do?

i was thinking of just emailing / writing the companies involved, with a photocard identification of myself, and telling them that either

1 - theyll have to accept that its not me that they should be chasing for the money, who it is, is there own problem, and they should remove the late payments before they turn into a default

OR

2 - theyll either have to accept and concede that they made a phone contract with someone who was 15 at the time, and (as far as i kniw) that would mean the contract and anything that goes along with it are null and void?

help would be appreciated

    also, would like to add, coz i know what forumers are like, theyll come along and start piping up

    1 - i did ask my dad why did he use my name with an alteration - and he said in all honestly, at the time he just wanted to see what would happen, the details of the person he gave did not actually exist, there is no Thomas J Sawyer, born on that date, that has or has ever been married, he said at the time it was curiousity, he was suprised to find a few days later a phone had been sent to him, and since then he just continued with the contract as the terms were pretty good - like i said, this was back in the day when they were really pushing contract sales over the phone

    and ive given him the benefit of the doubt, i dont think that almost ten years ago he was taking out a contract with any maliciousness in mind, i dont think he believed there would be a time he would get into such a tussle with the phone company he would just stop paying (he has a very high paying job, the issue was literally more over principle) and i dont believe he took it thinking 'yeh im gonna mess up my sons credit file in the future'

    so please, no self righteous comments about bad parenting or any rubbish like that

    You've been potentially screwed over by your own flesh and blood so not sure anyone would.

    That said, as soon as you post something on a public forum you leave yourself open to judgement. So not sure you can ask for 'no self righteous comments' and expect that to necessarily be the case.

    I don't think it will be enforceable on you though...not sure about your dad though. He could be in a bit of trouble for this given that he has paid it since the beginning and there is a clear audit trail.

    Just get your dad to settle the bill. Close the account and call and end to it.

    this is true, i just meant if anyone posts any that it wil fall on deaf ears, as i didnt come on to be judged and stuff

    this is what im more curious about, when i called the company and the woman mentioned fraud, as i was saying it isnt me, whoever it is is a different issue but its not me, two seconds later she looked at the account and said it couldnt possibly be fraud as many payments have been made into it, so there is a clear payment history coming from a bank, which i have nothing to do with. so im just wondering where is this likely to end up?

    i think that ultimately, this will happen if it looks like my credit file will take a big hit because of this, but on general principle, my issue with them isnt over the outstanding payment, its with what it on my credit file

    its the fact that they have sent the wrong details to the wrong person, they are adding on missing payments to someone who is 23 and is named TS, when in fact, the person they should be adding stuff to is someone who is in their 50's and is named TJS, like i said, while i do not agree with the idea that my dad believes this will be sorted and the result will be they are chasing a ghost. the fact still remains, that they are sending the wrong information to my credit file

    If I realised that I'd damaged my son's credit file with something like this I would be straight on to the phone company saying "I've done something a bit silly....." and sorting the whole mess out. Any chance of him doing that?

    yeh experian know the whole story mate lol, but they cant remove anything without the phone companies approval, who have already said to them that 'all information was accurate', we must get permission from the phone company first lol

    Technically you're right. But the alternative is that they pursue your dad for fraud. I suggest he pays up and settles the matter before it gets to that.
