Well you need to top it and tail it but it seems ok at first sight.
You should also say that the costs of running the business such as staff costs, signage, stationery, rent, rates are not to be included in the pre-estimate of loss.
Come back if the PPC sends in a witness statement and post it up, redacted where applicable.0 -
Yes, I have written that but left it out.
I can't imagine what sort of witness statement they could come up with! I will be submitting this to POPLA tomorrow as the 28 days is up on Thursday. Hopefully this will be the end of it.I have had many Light Bulb Moments. The trouble is someone keeps turning the bulb off

The witness statement is the latest concession that POPLA seem to have introduced to allow PPCs to produce instead of the contract we ask for.
If you want chapter and verse, do a search for threads stroma started and find the one that alludes to POPLA's impartiality. It is about a week or more old. Or if stroma is about, maybe you will get a direct link

Well done to you, can you post up the decision, the wording does help others who use popla - thanksWhen posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.

I'd be inclined to tell Morrisons in no uncertain terms that the actions of their agents (which have been found by the independent private parking appeals body, POPLA, to be without foundation) have caused them to lose (yet another) loyal customer.
It will help get it off your chest (and you might just find some nice vouchers in the post in an attempt by Morrisons to hang on to a loyal customer at a time when they are losing a significant percentage of market share against their big-4 rivals). Go for it, nothing to lose, potentially, much to gain. Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
