Santander - Money being taken without my permission

Hi, firstly apologies if this is in the wrong section, I wasn't quite sure where to put it but I really need some help!

Long story short, around 8 months ago I took a pay day loan out with Toothfairy Finance (big mistake I know!) anyway an unfortunate turn of rents meant I lost my job and was unable to pay them back. At first I had letters, then just calls and emails, after looking for advice around the Internet I wrote to them and described my situation and that I could literally afford nothing but I was committed to the debt. Since then I have had no written correspondence from them only an attempted call or two to my mobile everyday. The initial amount I owed was £544.

Go forward to today, I have finally got myself working again, and the feeling of having money I've worked for and being able to finally start getting somewhere with the one or two debts I have has been a massive relief.

Until Wednesday. My first pay packet in months got paid into my bank, hours later it was all gone, taken by toothfairy in numerous transactions I did not authorize. I immediately rang up Santander and told them and the said they would do nothing until they had fully processed, I asked them to block this company from trying any further payments. They said they couldn't and toothfairy have tried again since and now put me into the red and over my small overdraft on my account. Anyway I rang back once they were processed and showed up on my statement and requested this be reversed. I was told I would have to fill in a form that would be posted to me in 7-10 days, also including proof I'd contacted toothfairy to try and get my money back. The only way I could do this is over the phone and they would rip me to shreds, I have no confidence what so ever. They then said if have to wait whilst it was all investigated, the person on the phone wouldn't even give me a time frame.

I'm totally lost here, I've been left with absolutely nothing for the whole of the month, I explained this on the phone to santander and they were more concerned with letting me know about the charges I'll receive for going over my overdraft. I am absolutely devastated, how can this company take all my money without my concent, they have taken more than double what I borrowed. Can anyone help me? Is the only thing I can do is to wait and hope I win the dispute? I really need this money as I've committed to using it to begin paying off other people I also owe and to keep a roof over my head.

How can I get santander to stop this company from constantly trying to take money out of my account and get my money back asap?

    You did authorise the Pay Day loan company to take payments from your account when you applied for the loan.

    They'll keep taking the money from your stated account until you have paid them back in full. Looking at their website it appears that they charge 568% interest, so you will be paying back significantly more than what you borrowed.

    On what grounds? If it was a CPA, it can be cancelled on the bank's side nowadays.

    Open an account at another bank and get your wages paid in there.

    Having your wages paid into another bank is just s stopgap. The Tootfairy guys will come after you eventually, with bayliffs is they feel like it. You have to get this sorted, and they have to give you a reasonable chance to sort it.

    Hop over to the Debt Free Wannabee board - people over there know a lot better what you can do in your situation.

    As an aside, it seems to make no sense why Toothfairy should have waited with payment requests until you had a job again. Who told them you are working again? Why had they not asked for repayments whilst you were out of a job?

    Against future payments YES....

    Not anything that has been processed.

    Interesting to note the OP. Does mention contacting ToothFairy (is this for real) about the situation they were in, via letter.
    A lot is going to depend on what was in this letter.

    I guess that they have been constantly been trying to take funds for the last 8 months.

    Best advice by "agrinnall" and get a new bank account. That is if you can as many banks will now not touch people who use PDL co's and also will have a bad credit reference due to not paying a PDL co back.
    Best hope is a basic account.
