Hi received a 'parking charge notice' from excel parking services.
I have challenged it using a template from on these forums:
In regards to the invoice received with ref number xxxxxxx dated 30/02/2013, the keeper denies all liability to your company, if you reject this challenge the keeper requires within 35 days a popla verification code for them to appeal independently, per Version 2 of the BPA Code of Practice.
The keeper has nothing further to add, and will not respond to any correspondence from your company unless it contains the popla code. If you wish to find out why the keeper rejects all liability, please go via popla to find out
The challenge will be deemed accepted if there is no popla code on any rejection that you supply within the timeframe stipulated above.

we have since had a letter off them about 2/3 of the way through the 35 day window giving me options(pay up, notify whoever was driving to pay up, hand over details of them etc) however there is no POPLA code enclosed, should i just ignore all future correspondence now? if they try small claims court will it cost them more than what the parking charge is worth to initiate?

Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

ok thanks, what happens if i dont get a popla code from them within the 35 days? and would it be wise to send this asap or leave it till near the end of the 35 day period?

If they don't give you a POPLA code within 35 days they are in breach of the BPA Code of Practice and basically 'should' then be unable to pursue the registered keeper. I say 'should' because that won't stop them harassing you with the usual letters if you don't kill it at POPLA.
But if I were you I would aim to get this to POPLA asap because if you use our suggested example POPLA wording at that stage (which we can link here for you to copy & paste into a draft) you will win. I don't think I would leave it too close to the 35 days since your challenge, because they will probably still give you a POPLA code even then and you'll be taking it to POPLA anyway.
Did they send the NTK so that you received it within 14 days of the incident, if it was a postal camera-generated 'ticket'?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

If you want to have a bit of fun you could suggest that you are happy to see them in court if they fail to supply a POPLA code, but given their flagrant breaches of the Code of Practice they signed up to as members of the BPA Approved Operator Scheme they would be well advised to lay in a stock of toothbrushes in advance of meeting the good judge.Je suis Charlie.0

ok havent had a popla code from them and its been more than 35 days. i have however had a letter saying they have been to the dvla and can confirm who was the registered keeper etc and that if we dont pay up they will recover under the protection of freedoms act.
do i just ignore them now that they havent sent a POPLA code or do they have a leg to stand on?

Just looked again, letter is dated 5th Aug which is the 35th day of the message sent above not the "original challenge" as requested.
However they have attached a POPLA guidance and appeal form that has a verification code at the bottom, is this what I need?
