smart parking ticket

Hi All

My wife was visiting friends down south for a week went to matalan and parked in the car park (not realizing that it was a pay car park)

came out of shop only to find a penalty notice for £45-00

now whilst accept she made a mistake i fear £45-00 within 14 days is a rip off and i have appealed through their web site and without prejudice have offered £10-00 to end the matter,

I'm just wondering if i have done the right thing and any advice would be appreciated thank you

So this is England or Wales I gather? Did you admit who the driver was?

Your appeal will of course be turned down as they don't want a tenner they want the full unlawful penalty. So you should have waited until the notice to keeper but its done now.

On their rejection they should offer you a popla code to appeal independently. When you get come back here for help with that as you need a very strong defence that doesn't include mitigation, like what you've done already.

Yes it was a mistake, but don't worry: there are still many strong appeal points to use once you get the POPLA code.

No worries, just come back for help with the popla appeal, a lot of people make the mistake of contacting them before the notice to keeper, and if you were not the registered keeper that is the right thing to do. But it doesn't make this invoice any more enforceable than previously so in reality it will not make much difference at popla.

Good for you. Did they accept the tenner? :)

And name them as well. It would also be interesting to know on what grounds they have cancelled the tickets so others might be able to share in the bounty.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

Well Done! What points did you raise to get the parking charge cancelled?
