I have an email saying I contacted them on the 30th, an email saying I am entitled to a refund and to call the furniture department, and a payment reference for the £50 fee.

This is enough without having to write to them isn't it?

Thanks so much for the advice, I really appreciate all of it.

The email where you request cancellation is sufficient. An email from them saying that you can't cancel would probably satisfy a judge too that you did indeed request cancellation, but that won't be necessary now they are letting you cancel.

    Hi guys,

M&S said I can return them for the £50 fee. They would not just refund the difference no matter how much begging/indignation.

That is certainly their right, but it seems like bad business sense to me. They're losing the initial delivery costs when they didn't need to. I can only assume they were hoping the £50 return costs and the hassle would put you off, but that barely makes a dent in the money you stand to save..

Tell me about it - it seems so ridiculous, not to mention them having to make two new sofas and getting two (albeit in perfect condition) but technically second hand sofas back that they may not be able to sell. I just can't make sense of it.

I even said I'd be happy to have the difference minus the return cost!

Just wanted to say that after a few more phone calls M&S did refund me the difference in the end so kudos to them for that.

Thanks again guys, an excellent result!
