Tree less than 4 metres from property I am Buying

There is a tree (type of Conifer, approx 50 foot in height ) within 4 metres of the property I am buying.
The biggest cause of concern to me is that some of the roots have been sawn of by a neighbour to build his house extension, therefore I am unsure how stable this tree is.
This has not been picked up by either the mortgage survey or the Homebuyers.
I am thinking I need an expert to assess this tree and ease my mind as I would rather it didn't fall on my head either now or in the future.
Any suggestions as to what type of survey I would need?

Wouldn't you need the tree owner's permission for someone to go into his garden and inspect the tree?0 -
