The warden ? Christ Haswell has some bottle in his porta cabin lol
Thinking about this, if there are no ANPR there , and a parking scammer is why not put a fake ticket there ? Could it be that Haswell is trying to rush through these tickets quicker without the expense of cameras ?
NtD - dvla access after 28 days , then a further 28 days before they can do anything
NtK - dvla access immediately, then 28 before action can be taken

I looked at that link I gave to their website and it shows they use 'mobile ANPR vehicles' I am wondering if it was one of those which is why I just suggested to the OP that his challenge includes asking about that.
I am not sure that mobile ANPR vehicles actually fit within the requirements of the POF Act 2012 at all. As we know, the Bill originally said that tickets had to be placed on a windscreen. There was only a concession made later on when the Bill also recognised tickets issued by ANPR (but I wonder what the wording said about that?). As you say, why couldn't the driver just hop out and ticket cars?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

It says ANPR cameras are used to record 'overstays' - this was an out of bay marking. But they have already contradicted themselves by saying the notice relates to an unpaid contractual parking charge which remains unpaid. Firstly, there is no 'unpaid' charge as this is the first notification. Secondly, i am going to go back to the car park to read exactly what the signs say - do they really CLEARLY list all the possible contraventions including out of bay markings?
For now, my first appeal letter will be along these lines:
Dear Sirs
I am writing to you regarding parking charge with reference number xxx issued to vehicle xxxxx on xxx/2013. I was surprised to receive this, as the car was quite certainly not there then.
I don’t see how there is any possibility that you could have photographic evidence to support your claim but please can I request to see what ‘evidence’ of the contravention you claim to have. I would also like to know whether this was a warden situation, or self-ticketing, or ANPR? I assume you mean it was a warden who thought the car was 'out of bay' but I need to know which and to see your photos as I am quite certain your ‘evidence’ will fail.
In anticipation of your lack of evidence I would advise you to cancel this charge immediately as it stands no chance of a successful POPLA appeal. If you do not accept this challenge and cancel the charge, please provide me with a POPLA verification code where I will put forward a vigorous and evidence based appeal which will, inter alia, require you to produce various proofs including contractual approval to issue invoices, approval from your Principal to progress charges to court, details of a genuine pre-estimate of losses incurred by the landowner (your Principal), among many other points of appeal where PPCs have already failed at POPLA.
You will, of course, need to provide funding to the tune of £27 + VAT, for this to progress to POPLA, which, in the absence of a cancellation of the charge, is my legal right under the Protection of Freedoms Act 2012.
I look forward to receive either confirmation of cancellation of this charge or, in accordance with PoFA 2012, my POPLA verification code within 35 days of this challenge.

That looks good - maybe just edit the ANPR bit as I did edit my post #10 as UKCPS reckon they use 2 different sorts of ANPR (fixed or mobile). So ask which?
I reckon it's one of their mobile cameras and I don't think that's compliant with the POF Act. But anyway we know UKCPS are not renowned for their compliance in lots of ways do you will win this at POPLA.

I'm just thinking about their wording ie that this letter refers to a parking charge which remains unpaid. I could simply say, i have no idea- and ask them to send me the original payment invoice?0 -
I also assume they use ANPR cameras to have round the clock 24hr coverage of the car parks without always a warden present - it saves on wages and means they can use the footage to catch cars left overnight etc . Scums...0

Yep I would ask that question. What are they talking about, if they never issued a Parking Charge they cannot claim it remains unpaid as you are not psychic!

I just posted on another thread that I think life is too short for protracted correspondence with PPC scammers. So you really only want to write once don't you?
I would warn you though that UKCPS are known to NOT send a POPLA code with the first rejection and to pretend you have to do a second appeal. You could add that at the end of the letter:
'I am not a 'forum Guru' but please do not insult my intelligence by sending your usual template rejection letter pretending that I have to send a 'second appeal' and that you will then supply a POPLA code 'at the appropriate time'. THIS is the appropriate time, UKCPS, to either cancel this fake PCN or send a POPLA code with your rejection letter. No other response would be compliant.'
P.S. 'forum Guru' is a deliberate snipe at UKCPS. Use it if you like winding scammers up! They use the words to describe people like me and I find it hilarious!
