Please help: rights with uk based internet site but based in Germany

I recently bought an photo print ( meant for father's day) online with a company which I believed were based in the uk. This is because their website contains .co.uk at the end. The print arrived damaged. I asked them for a refund and their replied no, as they are based in Germany, their laws state its replacement only. As I have already bought a gift I don't need the print. Where do I stand with this please?

.co.uk doesnt mean they're based in the UK (which you probably now realise).
You would need to look into the terms and conditions and what German law is. I dont think anyone on MSE is familiar with it since its UK law we usually deal with.You keep using that word. I do not think it means what you think it means - Inigo Montoya, The Princess Bride0 -
2 issues - 1 you item was damaged, they offer replacement, all closed. Other is that you no longer want the item, and want a refund for it, nobody is going to accept that, it's custom work. The 2 aren't connected other than that you bought the print wanting it for a specific date - however as you probably didn't make that a part of the conditions of the order, I can't see how the supplier can really offer anything else?0

Why can't you just take the replacement they've offered and give it as a present at another occasion (even if you have to wait until Father's Day next year)?0
