Hello.
My DS drove two bus drivers to Birmingham to collect two buses last week. They stopped at Welcome Break on the return journey, they did not stay in the car park for over two hours.
However, they did pull into the petrol station on the way out, filled up the vehicles and set off. nOne of the buses wouldn't start, so DS pulled over on the one way exit from the services (safely out of the way), went back and arranged recovery.
Anyhoo, work have given him a letter from PE, photograph of the car going in and out of the services, accompanied with a £60 fine.
It seems a little unfair to snap folk on the way into the Welcome Break area car park, but instead of snapping vehicles leaving the car park, they position the camera to only snap vehicles leaving the whole services.
Anyhoo, should he appeal, ignore or pay up?
He is worried about naffing off the boss, he's only been there 2 months.

I ave a dodgy H, so sometimes I will sound dead common, on occasion dead stupid and rarely, pig ignorant. Sometimes I may be these things, but I will always blame it on my dodgy H.
Sorry, I'm a bit of a grumble weed today, no offence intended ... well it might be, but I'll be sorry.

Appeal straight away, which hooks the PCN in his direction and permanently away from the company. PE cannot revert to the registered keeper once they know who was driving.
Soft appeal wording discussed here (soft because it gives very little info away and is just designed to get a POPLA code out of them):
http://forums.pepipoo.com/index.php?showtopic=80125&st=20&start=20
You could add a paragraph about the situation and attach a copy of something to prove the recovery, as PE do sometimes cancel fake PCNs when an appeal has such evidence.
Then if PE do reject the first appeal, there's a second stage = POPLA (independent appeal).
The wording for that is very important, you can see from the 'POPLA decisions' sticky thread that we know how to win these now so make sure you get advice and read up on POPLA strong appeal wording at that stage.

That's a basic 'how to win at POPLA' summary but we have example templates too when you are ready. Hopefully PE will just cancel if the recovery is evidenced.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have read these forums about Parking Eye until I'm blue in the face or red considering what it's doing to our blood pressure!
My hubby wants me to ask on these threads about getting fines from this company. MOST problems are for overstay on such car parks, but in our case, we pulled into a car park in the Lake District about a fortnight ago, just to take refreshments. It was chucking it down and hubby just didn't bother getting a ticket! (not something we ever do usually)
Surely this is a different case than overstay, and I can imagine all the unsympathetic answers that are going to probably come back at me saying "you don't have a leg to stand on, pay it"
Please, some constructive help, urgent advice and opinions are needed. Do we ignore from PE or pay up?
Thanks in advance....0 -
You should really start your own thread...what you need to do is appeal. Don't worry that you look guilty you don't have to pay even if they say you do.twosharppencils wrote: »I have read these forums about Parking Eye until I'm blue in the face or red considering what it's doing to our blood pressure!

Yeah, you should start your own thread, but here goes.
Don't ignore Parking Eye as they do currently take "ignorers" as far as registering for potential court action with a Letter Before Action.
When was the alleged offense?
Has the Registered Keeper received a Letter within 14 days of the alleged over stay offense?
Your next course of action depends on when the notice to keeper was received.Search my post " PoPLA evidence - What to submit" on what is a good defense for a PoPLA appeal.0 -
HappyMJ and custard pie, thank you for your replies, but please tell me how to start my own thread, I can't see a way of doing it?0
