Child Abduction and claiming benefits

  • Lawyers who specialise in family law tend not to know the regulations about benefits. And it does not make financial sense to get a lawyer to answer a question that the benefit office can answer.

Very true, the family law lawyers are highly recommended for this case but it is the differing views of the first solicitor who started the legal proceedings, the current barrister and current expert family law solicitor that is creating confusion as some say because a criminal offence has occured it is ok to still claim benefits and the others say they are not sure.

I have tried calling a few welfare benefits solicitors but so far no one has called me back. If anyone could recommend a good solicitor to ask this question it would be greatly appreciated.
  • Errr, the 'state' can pay and does pay CTC for children living in an EEA country. It's covered in European regulations as it is an exportable benefit.

Thank you for the reply. Is the exportable benefit similar to what was mentioned in the news a few years ago when lots of families had moved to the UK to work but left their children in the native country? If I remember correctly they were still able to claim benfits whilst working in the UK even though their children did not?

I will look on google to see if I can obtain any information regarding this but f you know the European regulation number that covers this it would be appreciated.
