HI all
Please can anyone help, my flat was damaged by a leak from the roof, which occurred after thieves stole the tiles on the roof, causing damage to the drainage system.
Water now went through the walls and caused damage to my flat, due to damp leading to mold. The building insurers have refused to pay saying it is wear and tear .
What can I do. I guess court action would be next?

Did you report the theft to the police?

Yes the theft was reported to police few years ago when it happened
But the leak into the flat only started recently
The insurance is saying it is a long standing problem due to poor maintenance. While the management company which we pay service charge is saying the insurance, should pay.
The roof was recently repaired by the management company from their emergency fund, hoping building insurance would pay back, but they refused
My question is who do I go after the insurance or the management company0 -

There was a theft from the balcony of a flat a fees years ago which was reported to police but since we noticed the leak into the flats recently the surveyors check the roof and noticed the stolen lead which we think occurred at the same time .now the management has repaired the roof from emergency fund hoping insurance would pay back but they refused.
Now do I go after the insurance or the management company for the damage to my flat due to the leak or the insurance company as it has cost me over 5k to repair. Insurance say it is wear and tear due to poor main trance. And we pay service charge to management company0 -
Are you for real - the tiles were ''stolen'' 4 years ago and you are trying to claim now and the tiles have still not been replaced??
