I received a threatening letter (£75 with photos of my car arriving and departing) from Highview Livingston Almondvale Centre last year...a FREE car park.

I followed the MSE advice and the "legal" advice to just ignore the letters...a colleague did the exact same...after many "threats" and follow up letters from their associate company Debt Recovery Plus Ltd they eventually offered me a much reduced offer ...:rotfl::rotfl:

All this time i NEVER REPLIED ONCE to their letters...the price went up from£75 to £145.24 then reduced to £116 etc....farce!

It all looked very official....but it's NOT!

Speculative and unenforceable invoices....no Law will protect them...DO NOT PAY...DO NOT REPLY.

They've given up posting me letters now...last one was 8 months ago. :money:

I'm looking forward to Highview's third Threatagram from Almondvale. I saw a free car park, spent £50 in the shops and went home 3hrs later. Only to discover from their letter I was limited to 2 hrs!

Well tough! I didn't agree to any contact and they can whistle. The sad thing is, I really don't care - if they want to go to court I'm ready, but they've not got the guts.

Good result for you. However, as you're in Scotland 'ignore' is probably still current advice, as PoFA 2012 does not apply north of the border.

it is somewhat different in England and Wales now where PoFA does apply and 'ignore' is no longer primary advice. Soft challenge to PPC to hook a POPLA code followed by a forum-assisted appeal to POPLA can get the whole charade knocked on the head at the soonest opportunity. No need to endure months/years of junk through the letterbox.
Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
