Parking Eye and the Range!

Good afternoon, I'm afraid I have received a letter from Parking Eye due to parking in a carpark out of trading hours which I have done before but didnt see the sneaky signs put up and the anpr camera post.
Anyhow thanks to you all on here Iam writing to them to tell em to stuff it! ( in a polite way of course)
In their letter they have made a couple of mistakes, one is my full name is not on the letter just my christian names and secondly they state on entrance to the car park there is a sign stating the car park is on private land. The signs do not state this and there is not a sign at the entrance, there are just the same sized signs positioned on lamposts within the carpark, so if it goes to POPLA Im hoping these issues will asset, plus the others regarding the £100 being punitive.
Ive looked at the facebook page for the store which has others mentioning the charges sent to them, they have a simple " we are doing nothing wrong generic reply"
Im sure if they had a large sign at the entrance, no parking with £100 charge I wouldn't have parked there. But the signs starts with 2 hours parking in large letters, then smaller text saying customer only parking then even smaller text about the charge and times.

    Forget the incorrect name - won't cut any ice with PE, POPLA or a court. Concentrate in your inevitable POPLA appeal on the important things: right to form contract with driver, right to pursue tickets, unlawful penalty exceeding any losses/damages, breaches of BPA CoP (signage and anything else that comes up).

    Appeal to Parking Eye. This will be rejected so keep it short and simple.

    Make a note of all the dates involved, date of ticket, date of letters etc then come back when you have a POPLA code.

    The reason for noting dates is that Parking Eye make a complete mess of their timescales which is useful when appealing to POPLA.

    Understand your sentiments but you need to be even craftier than them.

    You send in a soft appeal along the lines recommended on most threads here. The sole purpose of this is to get their refusal and a POPLA Code. You need to ask for it as you can't go to POPLA till they give you one.

    You save your big guns for the POPLA appeal. Now ina addition to what looks like a winning point about lack of entrance signs (take photos to back up your point), you include the generic winning appeal points in the POPLA DECISIONS sticky at the top of the page.

    Now it's more satisfying to stuff them at POPLA after they have to pay the £27 + VAT for each case than to write them a snotty letter now.

To add its not as if the car park is full and they need to prevent people using it to allow their customers to park, its out of town and shared with three other companies.

    The last part is totally irrelevant to any appeal in the same way as speeding down an empty motorway with no traffic inconveniences no one. Not worth even including in any appeal as it will be totally ignored.

    (Yes, I know that the latter is a different scenario with real fines etc, but the mitigation seems to be the same)

    The Range has a stock (less than literate) response on its Facebook page:

    Please be reassured that all guidelines are followed in accordance to the British Parking Association. If you wish to appeal against the notice you have been issued, please follow the steps documented on the Parking Notice and provide your Proof of Purchase where your case will be reviewed by the ticket issuer.

    So, you might get the ticket cancelled if you have a proof of purchase (but don't hold your breath since this is Parking Eye we're talking about).

    Beware, then, of merely browsing in The Range. If they don't have anything you like, or it's out-of-stock, or you liked it all so much you just couldn't make your mind up, or having seen what you want you decide to buy it through their website - tough! That just cost you £100!

    How long would their business last if they were honest about this? "Parking free if you buy something, otherwise it's £100".

    The conclusion is obvious:

    DO NOT GO TO THE RANGE. EVER. FOR ANYTHING.

    Write to the council planning officer requesting the planning consent for the car park.
    This stipulates the rateable value of the car park.
    Pound says it stipulates "free parking"
    Then if it does send the rates office a copy of the invoice they sent you for parking and ask why they are defrauding the council of much needed income by calming free parking rates concessions yet charging £100 to park, after all that what they claim it is a "parking charge"
    I have done this before , the signs were down and the parking scammers gone within the week.

    I have received my rejection letter from Parking eye and they have provided me with a POPLA ref number. They have stated I have not provided sufficient evidence that I did not break the terms and conditions on the signage and that my queries are of a generic nature.

    they have then provided answers to FAQ's briefly they state on some points that:-
    1) the contract is set of via the signs which are in line with BPA and state winning cases.
    2) that parking eye have authority to issue and enforce PCN for contractual breach .
    3) that their charge is reasonable as £75 was deemed to be fair by HHJ Hegarty QC in 2011.
    4) Parking Eye confirm they have authority as they only operate on private land.

    So I now need to build my appeal via POPLA.
