Deposit Protection Scheme Insurance?

Hi all,

The estate agent we rented through has been closed due to investigations of fraud etc. Our deposit was with them (a whole 1k). I have been told that the deposit protection scheme (which I have checked and we are definatly registered with!) should reimburse us through their insurance.

Has anyone had any experience of this? I'm pretty nervous about whether I'll be getting it back.

    Which scheme is deposit with? Have you contcted them? Been on their website etc?

    Some of the schemes are insurance-based, ie the agent/landlord pays a premium each year to protect your deposit, but the actual money doesn't go to the scheme itself. Depending on which scheme your agent used, their rules and arrangements vary.

    I've popped them an e-mail to ask, fingers crossed as I have no idea what the next step would be.

    We're with TDS - Tenancy Deposit Scheme

    It says this : The Tenancy Deposit Scheme (TDS) is operated by The Dispute Service Ltd., a not for profit company authorised to provide insurance backed tenancy deposit protection as set out in the Housing Act 2004.

    Which Im guessing means we're covered through their insurance?

    Your contract is with the landlord, not the agent.

    You paid a deposit to the landlord via the agent. The LL is responsible for your deposit.

    Whether it is registered ornot, is a seperate matter. It should be of course, but

    * if it is, then your LL can release it in the normal way when the tenancy ends
    * if it is not, you can sue the LL in the normal way for failure to register the deposit (you can claim 3 times the deposit as penalty)
